This lawsuit challenged the Trump Administration’s attempted cancellation of the federal public housing requirement that tenants receive 30 days notice before eviction.

On February 26, 2026, the U.S. Department of Housing and Urban Development (HUD) adopted an Interim Final Rule (IFR) that rescinded a 2024 Final Rule titled, “30-Day Notification Requirement Prior to Termination of Lease for Nonpayment of Rent.” The 2024 Final Rule required federal public housing authorities (PHAs) and owners of properties receiving Section 8 Project-Based Rental Assistance (PBRA) to provide written notification to tenants facing eviction for nonpayment of rent 30 days before filing a formal judicial eviction procedure, and to allow the tenant to cure the arrearage during that 30 day period.

On March 2, 2026, the Jane Addams Senior Caucus, North Carolina Tenants Union, Maryland Legal Aid, and a PBRA tenant filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiffs sued HUD and its Secretary bringing claims for violations of the Administrative Procedure Act (APA). Represented by the National Housing Law Project, the Legal Aid Society of Eastern Virginia, and a private firm, the plaintiffs alleged that the 2026 Interim Final Rule was implemented without opportunity for public comment and rescinded the 2024 Final Rule’s 30 day notice period without cause, putting public housing tenants at risk for eviction and loss of their HUD subsidy, and violating the APA. The plaintiffs sought an emergency stay on implementation of the 2026 IFR, vacatur of the 2026 IFR, and fees and costs. The case was assigned to Judge Ana C. Reyes.

Before the court could hold a hearing on plaintiffs’ motion for preliminary relief, on March 13, HUD revoked and delayed the 2026 IFR, opened a public comment window on the proposed 2026 IFR, and reinstated the 2024 Final Rule. In light of this, the plaintiffs filed a notice of voluntary dismissal on March 16, 2026, and the court dismissed the case on March 17, 2026.
