The plaintiffs alleged that the federal defendants required grant recipients to certify that they did not operate "diversity, equity, and inclusion (DEI)" programs, did not promote "gender ideology," cooperated with federal immigration enforcement, and complied with various executive orders as conditions for receiving critical federal funding for disaster preparedness, victim services, law enforcement training, and water conservation programs. The complaint asserted several claims including violations of separation of powers, the Spending Clause, the Tenth Amendment, Fifth Amendment Due Process, and the Administrative Procedure Act (APA), arguing that the conditions imposed by the defendants were vague, unauthorized by Congress, and unconstitutionally coercive. The plaintiffs sought declaratory and injunctive relief to invalidate and prevent enforcement of these conditions, along with attorneys' fees and costs.

The case was initially assigned to District Judge Beth Labson Freeman. On March 17, 2026, however, District Judge William H. Orrick assumed jurisdiction over the case after it was related with County of Santa Clara v. Noem (No. 25-cv-8330-WHO).

On May 4, 2026, the plaintiffs moved for a preliminary injunction seeking to enjoin the defendants from imposing or enforcing the challenged grant conditions or any other similar conditions to federal funds received by or awarded to the plaintiffs, directly or indirectly. The plaintiffs argued that they were likely to succeed on the merits because the defendants placed conditions on congressionally appropriated funds to advance the Trump administration’s policy goals without any statutory authority to do so. They also contended they were likely to succeed on their APA claims because the imposition of the grant conditions was contrary to the Constitution, exceeded the defendants’ authority, and the defendants failed to provide any explanation for the grant conditions. The plaintiffs maintained that they would face irreparable harm without an injunction because they could not comply with grant conditions without potentially exposing themselves to legal liability or forgo funding without immediate consequences for their communities.

In their opposition, filed on May 18, 2026, the defendants argued that the plaintiffs could not challenge multiple distinct grant conditions imposed by different agencies at different times in a single suit – the conditions had to each be analyzed under their specific facts and legal background, but the plaintiffs failed to do this. Further, the defendants contended that the motion for preliminary relief was overbroad and the court lacked venue over claims involving grant programs in which the plaintiffs did not participate.

On June 17, 2026, the court held a hearing on the plaintiffs’ motion for a preliminary injunction. 2026 WL 1998576. The following month, on July 9, 2026, the court granted the motion, enjoining the defendants from imposing or enforcing the challenged grant conditions. The court held that the plaintiffs were likely to succeed on their constitutional claims because the grant conditions conflicted with Congress’s intent in enacting the relevant grants, were ambiguous so that it was nearly impossible for recipients to understand its meaning and application, and did not relate to the purpose of the grant programs. The court further held that the plaintiffs were likely to succeed on their APA claims because they had demonstrated that the grant conditions likely violated the Constitution and that the conditions departed from federal law and the statutory purposes of the grant programs without any explanation provided by the defendants. The court also explained, applying its reasoning in Santa Clara, that making the choice between accepting funding with potentially harmful or unconstitutional conditions or deciding to forgo funding constituted irreparable harm. The court asked the parties to file a proposed case schedule regarding next steps by July 31, 2026.
