OPINION AND ORDER re: (22 in 1:26-cv-02280-DEH) MOTION for Preliminary Injunction . filed by Hadeel Doe, Sam Doe, Ali Doe, Fahad Doe, Abdo Doe, Ebe Doe, Faiz Doe, (5 in 1:26-cv-02103-DEH) MOTION for Preliminary Injunction Pursuant to 5 U.S.C. § 705 Postponing Effective Date of Agency Action. filed by Kareem Doe, Malik Doe, Adan Doe, Rami Doe, Hassan Doe, Ibrahim Doe, Noor Doe, Omar Doe, Yusuf Doe. TPS holders from Yemen are not "killers, leeches, and entitlement junkies." They are ordinary, law-abiding people who have been granted status to be here because the Government has repeatedly determined, in accordance with the TPS statute, that Yemen is subject to an ongoing armed conflict, and that, due to that conflict, requiring them to return would pose a serious threat to their safety. That determination is subject to periodic review and can be changed. But Congress has, by statute, established a process for such review, which the Secretary failed to adhere to here. For the foregoing reasons, Plaintiffs' Motions to Postpone the effective date of the termination of Yemen's TPS designation are GRANTED. The Clerk of Court is respectfully requested to terminate ECF No. 5 in Case 26 Civ. 2103 and ECF No. 22 in Case 26 Civ. 2280. SO ORDERED. (Signed by Judge Dale E. Ho on 5/1/2026) (ks) (Main Document 39 replaced on 5/4/2026) (nm). (Entered: 05/01/2026)
