Nine Yemeni nationals filed a putative class action lawsuit on March 14, 2026, in U.S. District Court for the Southern District of New York, challenging the unlawful termination of Yemen's Temporary Protected Status (TPS) designation. The plaintiffs included six current TPS holders and three individuals with pending applications, representing all Yemeni nationals who hold TPS or have pending applications under Yemen's designation. They sued Secretary of Homeland Security Kristi Noem, the Department of Homeland Security, U.S. Citizenship and Immigration Services, and the United States, alleging that defendants improperly terminated Yemen's TPS designation effective May 4, 2026, despite the country's ongoing humanitarian crisis and armed conflict. The complaint asserted that this termination, affecting approximately 2,810 current TPS holders and foreclosing adjudication for 425 pending applications, was made without proper agency consultation and was motivated by racial, ethnic, and national-origin-based discrimination as part of a pattern targeting non-white, non-European countries. Plaintiffs brought claims under the Administrative Procedure Act for arbitrary and capricious agency action and Fifth Amendment equal protection violations, seeking declaratory and injunctive relief to prevent the termination from taking effect.

On March 15, 2026, the plaintiffs filed a motion for a preliminary injunction. On March 16, 2026, the plaintiffs referred the case to Judge Katherine Polk Failla as possibly related to 1-25-cv-08686 (Noem v. Dahlia Doe). Judge Faila declined the case as not related, and it was assigned to  Judge Dale E. Ho. 

On May 1, 2026, the court granted the plaintiffs’ motion for a preliminary injunction to postpone the effective date of termination of Yemen’s Temporary Protected Status designation. 2026 WL 1192079. Judge Ho reasoned that, although ordinarily he would wait for guidance from the Supreme Court as two TPS cases had been argued earlier that week, given the consequent loss of legal status for approximately 3,000 people, a ruling on the motion at this juncture in the proceedings was necessary. Turning to the merits,the court found that the plaintiffs had shown the requisite likelihood of success on the merits of their claim as the Defendant’s email thread discussing the State Department’s decision to terminate TPS for Yemen contained no discussion of the conditions of Yemen as required under the APA. The court also found that the plaintiffs showed the requisite irreparable harm as they would lose their lawful status and right to work in the country, which jeopardizes their access to medical care, puts them at risk for detention, deportation, and family separation, and may force certain applicants to encounter violence and repression if made to return to Yemen. Last, the court held that the plaintiffs showed that the balance of the equities and public interest weigh in their favor when measured against the defendants’  inability to implement a statute as they see fit. The court therefore postponed the effective date of termination indefinitely. 

On May 28, 2026, and pursuant to a joint status report submitted by the parties, the court stayed the matter pending the Supreme Court’s decisions in Noem v. Dahlia Doe and Trump v. Miot, with an exception of briefing on class certification.

This case is ongoing.

ORDER granting 25 Letter Motion for Leave to File Excess Pages. On April 16, 2026, the Court heard argument on Plaintiffs' Motions to Postpone the termination of Temporary Protected Status for Yemen. The Court has taken those arguments under advisement and will rule on the Plaintiffs' Motions in due course. TPS holders from Yemen are not "killers, leeches, and entitlement junkies." They are ordinary, law-abiding people who have been granted status to be here because the Government has repeatedly determined, in accordance with the TPS statute, that Yemen is subject to an ongoing armed conflict, and that, due to that conflict, requiring them to return would pose a serious threat to their safety. That determination is subject to periodic review and can be changed. But Congress has, by statute, established a process for such review, which the Secretary failed to adhere to here. For the foregoing reasons, Plaintiffs' Motions to Postpone the effective date of the termination of Yemen's TPS designation are GRANTED.
