Plaintiff states included Massachusetts, California, Illinois, Wisconsin, Colorado, Connecticut, Delaware, District of Columbia, Hawaii, Maine, Maryland, Michigan, Minnesota, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Virginia, and Washington. The lawsuit challenged vague funding conditions imposed by USDA, known as the "2026 Conditions," which became effective December 31, 2025, and applied to all USDA programs, grants, cooperative agreements, and mutual interest agreements. These conditions required recipients to certify compliance with "all applicable Federal anti-discrimination laws, regulations, and policies," prohibited the use of funds to "promote gender ideology" or for programs that "deprive women and girls of fair athletic opportunities," and barred funding for programs that "allow illegal aliens to obtain taxpayer-funded benefits". Plaintiffs alleged that these unconstitutionally vague conditions threatened over $74 billion in annual federal funding to the states for essential programs, including nutrition assistance, agricultural support, forestry, and fire prevention. The states brought six causes of action under federal question jurisdiction, alleging violations of the U.S. Constitution's Spending Clause and multiple provisions of the Administrative Procedure Act. They sought declaratory and injunctive relief to prevent implementation of the challenged conditions, along with vacatur of the conditions and attorney's fees.
