On March 23, 2036, the Washington Area Bicyclist Association, Inc. (WABA) filed suit in U.S. District Court for the District of Columbia against multiple federal officials and agencies. Defendants include U.S. Secretary of the Interior, the Department of the Interior (DOI), the Acting Director of the National Park Service (NPS), the NPS, the Secretary of Transportation, the Department of Transportation (DOT), the Administrator of the Federal Highway Administration (FHWA), and the FHWA. WABA alleged that in 2021, after an extensive public consultation process, the NPS and D.C. DOT installed protected bicycle lanes along 15th Street, NW, including portions crossing the National Mall, to reduce congestion and improve safety for bicyclists and other road users. According to the complaint, data showed bicycle injury accidents on this portion of 15th Street plummeted by more than 90% after lane installation. However, WABA alleged that NPS, in partnership with the FHWA, planned to remove the 15th Street bike lanes, as well as bike lanes along Ohio Drive, SW, and East Basin Drive, without safety consideration or public consultation, citing unsubstantiated traffic concerns and upcoming events like the National Cherry Blossom Festival and America's 250th anniversary. WABA contended this removal would put lives at risk and sever one of D.C.'s longest protected bike lanes. Plaintiff brought four claims under the Administrative Procedure Act (APA), alleging violations including failure to consult with the National Capital Planning Commission, arbitrary and capricious decision-making, failure to undertake a National Environmental Policy Act assessment, and failure to comply with the NPS Organic Act⁻. WABA sought injunctive and declaratory relief to halt the bike lane removal project and prevent future removals until defendants satisfied their legal obligations.
