This case concerns a challenge brought by seven Yemeni TPS holders and one Yemeni TPS applicant regarding the Department of Homeland Security’s termination of Yemen’s Temporary Protected Status designation, in which the plaintiffs argued that this decision unlawfully stripped them of protections despite an ongoing conflict in Yemen. 

On March 19, 2026, seven Yemeni nationals, using pseudonyms and represented by counsel, filed a putative class action lawsuit in the U.S. District Court for the Southern District of New York challenging the government's termination of Temporary Protected Status (TPS) for Yemen. The plaintiffs, six of whom hold TPS status and one with a pending TPS application, sued the Department of Homeland Security (DHS), and its component agency U.S. Citizenship and Immigration Services (USCIS). The lawsuit alleged that defendants unlawfully terminated TPS for Yemen on March 3, 2026, with an effective date of May 4, 2026; plaintiffs claimed the decision was made without proper statutory consultation with other agencies and was not based on an objective review of country conditions. Plaintiffs contended that Yemen continues to experience armed conflict and a humanitarian crisis that prevents safe return, and alleged the termination was part of a preordained political agenda to eliminate TPS protections motivated by discriminatory animus against non-white immigrants. The complaint included three causes of action: two under the Administrative Procedure Act (APA) alleging the termination was arbitrary, capricious, procedurally defective, and represented an improper departure from established practices, and a Fifth Amendment Equal Protection claim alleging discriminatory animus based on race, ethnicity, religion, or national origin. Plaintiffs sought a declaration that the termination was unlawful and unconstitutional, injunctive relief to set aside or stay the termination, orders keeping TPS designation in effect, attorneys' fees, and other equitable relief. The case was assigned to District Judge Dale E. Ho. 

On March 19, 2026, the Court issued a statement relating this case with another case in the same Court and before the same judge, Doe v. Noem (1:26-cv-02103). 

The plaintiffs filed a motion for a preliminary injunction on March 25, 2026, which the court granted on May 1. 2026 WL 1192079. First, the court found that jurisdiction over the plaintiffs’ claims is proper because the plaintiffs challenged the alleged procedural failures of the Secretary, rather than any substantive determinations that were made. The Court also determined that the plaintiffs were likely to succeed on the merits of their claims. The court explained that the Secretary failed to consult with the appropriate governmental agencies or review the conditions in Yemen that originally permitted its TPS status, as required by statute. The record showed that there was a limited email exchange discussing the TPS status of Yemen, primarily concerning scheduling the termination, rather than assessing the conditions in the country. Additionally, the court recognized that the plaintiffs would suffer irreparable harm upon termination of Yemen’s TPS designation, including loss of access to employment and medical care; immediate threat of arrest, detention, and deportation; and family separation. Because of a travel ban on Yemen that prevents asylum applications from being adjudicated, asylum could not be sought as an alternative remedy to TPS. 

The plaintiffs moved for class certification on March 26, 2026. On April 1, they moved to compel the Defendants to produce the certified administrative record. The court granted this motion on April 7, declining to speculate about the impact of the Supreme Court’s pending decision on consolidated cases (Noem v. Doe and Trump v. Miot) regarding TPS designation for Syria and Haiti. 2026 WL 937252. Defendants produced the administrative record on April 14, but some information was redacted without explanation. 

There was significant litigation in April over redactions and law enforcement privilege; the Court largely ruled in plaintiffs’ favor. On April 21, the defendants filed a previously withheld USCIS decision memorandum signed on December 28, 2025 recommending that TPS designation for Yemen be terminated because the country no longer met the criteria for experiencing an ongoing armed conflict and that there was a national security risk if the TPS was to be maintained. 

After briefing on case management, on May 28, 2026 the court found that a partial stay was warranted pending the Supreme Court’s decision in Noem and Miot. 2026 WL 1498972. However, the court ordered the parties to continue briefing on class certification. 

On June 25, 2026, the Supreme Court issued its ruling in Noem and Miot, holding that federal courts are not permitted to review procedural challenges - those that are non-constitutional - to the government’s termination or designation of TPS. This decision vacated lower court injunctions that had blocked the termination of TPS for individuals from Haiti and Syria. 

On June 28, 2026, the defendants filed a notice of interlocutory appeal to the U.S. Court of Appeals for the Second Circuit appealing the District Court’s May 1 order postponing the termination of Yemen’s TPS designation. Briefing in this court remains ongoing. 

On June 30, in the District Court, the defendants moved to stay the case pending the appeal and for an indicative ruling; the defendants asked the court to state that it would vacate its order delaying the TPS termination if the Second Circuit remanded the case for that purpose. 

On the same day, June 30, the parties filed a joint status letter addressing their positions on the Supreme Court’s ruling. The plaintiffs argued that the Supreme Court’s ruling does not reach the claims that the plaintiffs are asserting because the bar of judicial review does not extend to constitutional claims. Further, while the Supreme Court addressed claims of racial discrimination, the plaintiffs in this case alleged that the termination of Yemen’s TPS designation discriminated against the plaintiffs on the basis of national origin, which the Supreme Court’s analysis of Equal Protection does not reach. The defendants maintained that the District Court’s May 1 order should be vacated in light of the Supreme Court’s decision because that court addressed nearly identical claims, and held those claims were unlikely to succeed. 

As of July 1, 2026, this case remains ongoing.

TPS holders from Yemen are not "killers, leeches, and entitlement junkies." They are ordinary, law-abiding people who have been granted status to be here because the Government has repeatedly determined, in accordance with the TPS statute, that Yemen is subject to an ongoing armed conflict, and that, due to that conflict, requiring them to return would pose a serious threat to their safety. That determination is subject to periodic review and can be changed. But Congress has, by statute, established a process for such review, which the Secretary failed to adhere to here. For the foregoing reasons, Plaintiffs' Motions to Postpone the effective date of the termination of Yemen's TPS designation are GRANTED.
