Case Summary
This investigation addresses allegations of race-based discrimination in the school's admissions policies and practices as well as allegations of antisemitic discrimination on campus.
On April 11, 2025, the Department of Justice Civil Rights Division sent the first of seven letters to the University of Virginia seeking data and records to assess the school's compliance with Title VI of the Civil Rights Act of 1964, as interpreted post-SFFA. With subsequent letters, the DOJ's demands and allegations expanded to include the presence of Diversity, Equity, and Inclusion (DEI) initiatives and "antisemitic discrimination, harassment and abuse, and related retaliation . . . directed towards UVa students and employees who are Jewish, Israeli, and Israeli-American." By the final letter sent on June 17, 2025, the investigation included the undergraduate program, law school, medical school, nursing school, business school, education school, public policy school, and commerce school. The June 17 letter asserts that the use of race by UVa is a "widespread practice[] throughout every component and facet of the institution" and explicitly threatened the termination of federal funds if corrective action was not taken.
In the following weeks, the DOJ repeatedly demanded that UVa's president step down before other negotiations could occur, leading to his resignation announcement on June 27, 2025. On July 10, 2025, a coalition of 40 Jewish UVa faculty released a joint statement criticizing the DOJ's "weaponization of antisemitism" and arguing that its use in broader attacks on higher education, like this investigation, does harm to Jewish people rather than protecting them.
After ongoing negotiations and a rejection of a DOJ-proposed agreement, a settlement was announced on October 22, 2025. The DOJ agreed to pause all investigations into the school in exchange for the submission of quarterly reports of the university's "progress towards full compliance with the Civil Rights Laws" issued until the end of 2028.
