This case challenges a federal policy allegedly permitting Immigration and Customs Enforcement officers to enter homes without warrants during immigration enforcement operations.

Six plaintiffs, including U.S. citizen nurses married to noncitizens and individuals with final removal orders, filed suit against the U.S. Department of Homeland Security (DHS) and various officials on April 2, 2026, in the U.S. District Court for the District of Columbia. The plaintiffs alleged that DHS issued a secret memorandum in May 2025 (the "Home Entry Memo") that authorized Immigration and Customs Enforcement (ICE) agents to forcibly enter homes without judicial warrants based solely on administrative Form I-205s, reversing decades of practice requiring judicial warrants. Federal agents subsequently conducted warrantless forced entries into plaintiffs' homes in Minnesota between December 2025 and January 2026, using battering rams, drawn weapons, and military-style tactics that traumatized families including young children. The plaintiffs brought six claims under the Administrative Procedure Act (APA) and the Fourth Amendment, seeking declaratory relief, vacatur of the memo, injunctive relief, and attorneys' fees. The case was assigned to District Judge Tanya S. Chutkan.

On May 21, 2026, the defendants filed a motion to extend their time to answer to the complaint on the basis that Secretary Mullin had pasued the challenged policy while he conducted a review. The court denied this motion without prejudice on May 29, 2026, holding that this did not require the lengthy three month delay that the defendants sought. The court allowed the defendants to renew their request for an extension to respond to the complaint, but required that they attach affidavits from relevant agency officials concerning the length of the proposed extension in light of the plaintiffs’ contention that they are facing significant ongoing harm as a result of the challenged policy.

The defendants filed a second motion for an extension to respond to the complaint on June 3, 2026 which was granted the following day on June 4 for good cause shown. They were ordered to respond by June 22, 2026. The defendants moved for an extension again on June 22, 2026.

On June 23, 2026, the defendants moved to dismiss the case for lack of jurisdiction and for failure to state a claim. A few days later on June 29, 2026 the defendants moved for relief from Local Civil Rule 7(n) as it pertained to their motion to dismiss. The defendants specifically sought an order staying the deadline to file the certified administrative record index until sixty days after they filed an answer to the complaint, if it were necessary to file the answer after the court ruled on the defendants' motion to dismiss.

On July 1, 2026, the court granted the defendants’ June 22 motion for an extension of time. On the same day, the plaintiffs filed a motoin to hold their deadline to respond to the defendants' motion to dismiss in abeyance pending the court’s ruling on the defendants’ motions for relief and the plaintiffs’ forthcoming motion for discovery. The court granted this motion on July 6, 2026.

As of July 14, 2026, this case is ongoing.

While the court notes that this is Defendants' first extension request, Defendants' stated basis--that Secretary Mullin has "paused" the challenged policy while he conducts a review--does not, without more, necessitate nor warrant such a lengthy delay in the Government's response to Plaintiffs Complaint.
