The plaintiffs alleged that DHS issued a secret memorandum in May 2025 (the "Home Entry Memo") that authorized Immigration and Customs Enforcement (ICE) agents to forcibly enter homes without judicial warrants based solely on administrative Form I-205s, reversing decades of practice requiring judicial warrants. Federal agents subsequently conducted warrantless forced entries into plaintiffs' homes in Minnesota between December 2025 and January 2026, using battering rams, drawn weapons, and military-style tactics that traumatized families including young children. The plaintiffs brought six claims under the Administrative Procedure Act (APA) and the Fourth Amendment, seeking declaratory relief, vacatur of the memo, injunctive relief, and attorneys' fees. The case was assigned to Judge Tanya S. Chutkan.

MINUTE ORDER: Defendants' 11 Motion for Extension of Time is DENIED for failure to show good cause. While the court notes that this is Defendants' first extension request, Defendants' stated basis--that Secretary Mullin has "paused" the challenged policy while he conducts a review--does not, without more, necessitate nor warrant such a lengthy delay in the Government's response to Plaintiffs Complaint. As Plaintiffs point out, Defendants have not proffered any details of the "pause" beyond their attached 4-sentence letter from the Secretary to Senator Blumenthal. The court is therefore left to speculate how the pause is being implemental, what effect it will have across the agency, how it relates to Plaintiffs' claims, and when the Secretary plans to complete his review. Moreover, a three-month extension would be prejudicial to Plaintiffs, who have alleged that they face significant ongoing harm. For these reasons, the court will DENY Defendants' request but will do so without prejudice. If Defendants wish to renew their request, Defendants should attach affidavits from relevant agency official(s) addressing the court's stated concerns.
