This case challenges President Trump's executive order restructuring federal election administration by requiring federal citizenship verification measures and imposing new restrictions on mail-in voting.
The National Association for the Advancement of Colored People (NAACP) and four other civil rights organizations filed suit against President Donald J. Trump, numerous federal agencies, and federal officials in the U.S. District Court for the District of Columbia on April 3, 2026. The complaint challenged President Trump's Executive Order entitled "Ensuring Citizenship Verification and Integrity in Federal Elections" (“Order”), issued on March 31, 2026. According to the plaintiffs, the Order represented a renewed attempt to regulate federal elections through executive action after courts had previously invalidated a prior election-related executive order. The plaintiffs alleged that the Order required the Department of Homeland Security (DHS) to compile "State Citizenship Lists" using federal citizenship and Social Security databases, required the U.S. Postal Service (USPS) to restrict delivery of mail-in ballots to voters appearing on federally generated participation lists, and directed the Department of Justice (DOJ) to prioritize investigations of state and local officials who failed to comply. The plaintiffs brought six claims alleging ultra vires presidential action, violations of separation of powers principles, infringement of the constitutional right to vote, violations of the USPS's governing statutes, and violations of the Privacy Act and Administrative Procedure Act. They sought declaratory and injunctive relief to block implementation of the Executive Order.
On April 10, 2026, the district court consolidated this case with two related challenges to the same Executive Order, and all future filings were directed to the lead case, DSCC v. Trump.
