Case Summary
This is a case challenging the U.S. Office of Management and Budget's (OMB) failure to respond to Freedom of Information Act requests for the calendars and schedules of senior OMB officials involved in reviewing, delaying, and rescinding environmental protections. Per the complaint in this lawsuit, the Center for Biological Diversity submitted five FOIA requests to OMB, dating back to March 2025, seeking the calendars and schedules of these officials to track how their actions carried out the environmental rollbacks and large-scale workforce reductions undertaken during the Trump administration.
On April 13, 2026, the Center for Biological Diversity, an environmental nonprofit organization, filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiff sued OMB under the Freedom of Information Act (FOIA) . Represented by the Center for Biological Diversity’s in-house counsel, the plaintiff sought declaratory and injunctive relief requiring OMB to immediately make determinations on the FOIA requests, conduct proper searches, and produce all nonexempt responsive records, as well as attorneys' fees and costs.
The plaintiff brought three claims under FOIA: that OMB failed to comply with mandatory determination deadlines, failed to conduct an adequate search for responsive records, and failed to promptly disclose all responsive records. This case was assigned to District Judge Rudolph Contreras.
On June 29, 2026, the court reviewed the parties' submitted joint status report, in which they reported that OMB had begun to process and respond to the FOIA requests, and ordered the parties to submit an additional joint status report by September 14, 2026.
As of July 6, 2026, this case is ongoing.
