This case challenges the U.S. Environmental Protection Agency (EPA)’s refusal to officially identify and publish, in the Federal Register, areas in the country with air pollution levels that violate federal clean air standards within the two (2) year deadline –thus seriously threatening public health. The Clean Air Act requires the EPA to establish health-based national ambient air quality standards to limit the amount of particulate matter (PM) allowed in the outdoor air. Areas with pollution …

On February 7, 2024, the EPA strengthened the national ambient air quality standard for fine particulate matter (PM 2.5), commonly known as "soot", on February 7, 2024, setting the annual limit at 9.0 micrograms per cubic meter, down from the previous 12.0 μg/m. This action triggered EPA's non-discretionary duty to promulgate air quality designations for all areas of the country within two (2) years (by February 7, 2026) and publish notice in the Federal Register.

On April 13, 2026, seventeen (17) non-profit environmental and health organizations, with over 1.5 million members collectively, filed suit in the U.S. District Court for the Northern District of California. The plaintiffs sued against the Administrator of the EPA, in his official capacity, under the Clean Air Act, 42 U.S.C. § 7604(a)(2); Mandamus, 28 U.S.C. § 1361; and the Administrative Procedure Act, 5 U.S.C. §§ 701-706. Represented by Earthjustice, the plaintiffs sought relief in the form of a declaratory judgment and injunctive relief–in an attempt to compel the EPA administrator to carry out his legal obligation to officially identify and publish areas that are not in compliance with the Clean Air Act. Additionally, the plaintiffs sought an order requiring the Administrator to promulgate air quality designations and publish notice in the Federal Register, retained jurisdiction to ensure compliance, costs and attorneys' fees, and other just and proper relief.

The plaintiffs claim that the statutory deadline to post the national ambient air quality standard for fine particulate matter had passed, and the Administrator failed to promulgate any designations under the 2024 standard for any area of the country. They claimed that over 75 million Americans live in areas where PM 2.5 pollution levels violate the 2024 standard. The case was assigned to District Judge Haywood S. Gilliam Jr.

On April 13, 2026, the plaintiffs filed a motion for summary judgment claiming there is no genuine dispute of material fact because the defendants did not fulfill their mandatory duty under the Clean Air Act by February 7, 2026. On May 27, 2026, the Court granted an order to procedurally coordinate (not consolidate) the case, on summary judgment, with another case also challenging the same EPA inaction.

The defendant’s counsel filed a response to the motion for summary judgment on June 1, 2026.

On June 25, 2026, plaintiff argued and filed for motions for summary judgment and defendants argued and filed a motion for abeyance (request for temporary pause in case) argued and submitted. In their motion for summary judgment plaintiffs cited a new D.C. Circuit opinion Kentucky v. EPA (decided June 26, 2026) upholding the EPA's 2024 National Ambient Air Quality Standards (NAAQS) that tightened the strict limits on fine particulate matter (PM2.5).

As of June 30, 2026, these two motions are pending before the court and this case is ongoing.
