On January 15, 2026, the American Civil Liberties Union Foundation of New Hampshire filed this action in the U.S. District Court for the District of New Hampshire against ICE under the Freedom of Information Act (FOIA). The plaintiff alleged that ICE unlawfully withheld records concerning training materials used to instruct local law enforcement participating in Section 287(g) programs, including the revived Task Force Model, which authorizes designated local officers to perform certain federal immigration enforcement functions under ICE supervision. The plaintiff sought declaratory and injunctive relief requiring ICE to produce the requested records and attorneys’ fees and costs. The case was assigned to District Judge Steven J. McAuliffe.

According to the complaint, the ACLU of New Hampshire submitted a FOIA request to ICE on October 29, 2025, seeking training materials used to instruct officers participating in all active Section 287(g) programs, including the recently revived Task Force Model. The complaint alleged that, although ICE acknowledged the request and invoked a statutory extension of time, it failed to make a substantive determination or produce responsive records within FOIA’s deadlines. The requested records concerned training provided to approximately 138 officers from 13 New Hampshire law enforcement agencies that had entered into Section 287(g) agreements with ICE following the expansion of the program in 2025. The plaintiff alleged that disclosure was necessary to evaluate the adequacy of the training provided to local officers exercising federal immigration enforcement authority, particularly given concerns about racial profiling and civil rights violations associated with prior iterations of the program.

On March 23, 2025, ICE filed its answer denying that it had violated FOIA.

As of June 2026, no substantive rulings had been made, and the case remained ongoing.
