Environmental Working Group (EWG), a nonprofit organization, filed a petition for writ of mandamus against the U.S. Environmental Protection Agency (EPA) on April 21, 2026, in the U.S. Court of Appeals for the D.C. Circuit. Plaintiff had submitted an administrative petition to EPA in 2018, amended in 2019, requesting that the agency revoke or modify the tolerance for glyphosate on oats and restrict pre-harvest uses that drive dietary exposure. The petition alleged that dietary glyphosate exposure poses heightened risks to infants and young children, particularly because oat-based products are widely consumed by children and glyphosate residues have been detected in foods marketed to children. Despite more than seven years passing, EPA allegedly failed to issue any final, reviewable decision on the petition. Plaintiff sought a writ of mandamus under the Administrative Procedure Act to compel EPA to issue a final response within sixty days.
