The Department of Government Efficiency (DOGE) is an initiative introduced by the second Trump administration, which is tasked with reducing government spending and cutting jobs. On May 8, 2026, Plaintiffs - individual recipients of federal benefits or who have otherwise entrusted sensitive personal information to the government - filed this lawsuit in the U.S. District Court for the District of Columbia. Plaintiffs sued the U.S. Office of Personnel Management (OPM), the U.S. Department of the Treasury (Treasury), and The Social Security Administration (SSA). Represented by private counsel, Plaintiffs alleged unauthorized disclosure of return information which includes taxpayer identity, mailing addresses, Social Security numbers, taxpayer identification numbers, and refund-related account and payment data for millions of taxpayers who have engaged in financial transactions with the federal government. Plaintiffs also alleged violations of the Privacy Act of 1974, asserting that OPM, Treasury, and SSA allegedly failed to take steps to implement appropriate safeguards to insure the security of federal records that store personal sensitive information and to protect against any anticipated threats or hazards to their security. Finally, Plaintiffs alleged violations of the Administrative Procedure Act, alleging that the defendants granted DOGE-affiliated individuals access to sensitive federal records without conducting the required assessments before altering access to such records. Per the complaint, the alleged breach of privacy led to individuals' information becoming available on the dark web. Plaintiffs requested class certification, monetary damages, and declaratory and injunctive relief. They sought to represent a so-called “Personal Sensitive Information (PSI) Class,” which would consist of all individuals whose personal sensitive information was maintained in any federal system of records and was made available for access by DOGE or by DOGE-created user accounts between January 1, 2025, and May 4, 2026. The case was assigned to District Judge Tanya S. Chutkan.
