Represented by the Washington Litigation Group, the Foundation brought claims under the National Historic Preservation Act (NHPA), the National Environmental Policy Act (NEPA), and the Administrative Procedure Act (APA), alleging that federal officials unlawfully approved and began implementing a project to resurface the Lincoln Memorial reflecting pool's grey tiling with a bright blue coating without completing the consultation and review process required by Section 106 of the NHPA. Plaintiffs alleged that the project would substantially alter the historic character and appearance of the pool and that the agencies failed to adequately consider the effects of the proposed changes on a protected historic resource. Plaintiffs sought to recover attorney fees, declaratory relief, and injunctive relief, including a temporary restraining order, preliminary injunction, and a stay of agency action pending judicial review. The case was assigned to District Judge Carl J. Nichols.


On May 11, 2026, Plaintiffs moved for a temporary restraining order, preliminary injunction, and stay pending review, arguing that construction activities were imminent and that irreparable harm would occur absent immediate judicial intervention. On June 3, 2026, the federal government notified the court that the resurfacing of the Lincoln Memorial Reflecting Pool had been completed. As of June 2026, the motion remains pending.
