American Oversight, a nonpartisan, non-profit organization dedicated to government transparency, filed a complaint on June 3, 2026, in the U.S. District Court for the District of Columbia against the U.S. Department of Homeland Security (DHS) and U.S. Customs and Border Protection (CBP). The complaint arose against a backdrop of record rates of reported deaths in immigration custody in 2025 and 2026, and DHS's March 2025 announcement of plans to close its Office of Civil Rights and Civil Liberties (CRCL) and the Office of Immigration Detention Ombudsman (OIDO), two offices with statutory responsibilities to investigate detainee treatment. The plaintiff alleged that, although DHS eventually allocated a small number of staffers to CRCL and OIDO, records from related litigation demonstrated that these offices had failed to respond to civil rights complaints or meaningfully address detention conditions or deaths. On April 2, 2026, the plaintiff submitted four Freedom of Information Act (FOIA) requests to DHS, DHS's Office of Inspector General (OIG), and CBP, seeking records regarding policies and protocols concerning immigration custody deaths and the status of CRCL and OIDO investigations, to which the defendants had not responded. The plaintiff asserted in its complaint two counts of FOIA violations: first, failure to conduct adequate searches; and second, wrongful withholding of non-exempt records. The plaintiff sought production of the requested information along with attorneys' fees and costs.
