[This summary is temporary while we research the case]. On June 3, 2026, in the U.S. District Court for the District of Columbia, the PA Education Association (PAEA) and the American Academy of Physician Associates (AAPA) filed a complaint against the U.S. Department of Education (DOE) and Secretary of Education Linda McMahon, challenging a final rule that plaintiffs alleged would effectively strip Physician Assistant (PA) students of access to higher federal loan limits. Since 2006, PA students had relied on graduate federal loan programs, including Grad PLUS loans, because PA degrees satisfied the existing regulatory definition of "professional degree." In 2025, Congress passed the "One Big Beautiful Bill Act," which eliminated the uncapped Grad PLUS program and established a new annual loan cap of $50,000 for "professional students," adopting the pre-existing regulatory definition of "professional degree." Then on May 1 2026, the DOE issued a Final Rule entitled "Reimagining and Improving Student Education," which rewrote the definition of "professional degree" by adding requirements—including that a qualifying degree be "generally at the doctoral level," require at least six academic years of postsecondary education, and share a specific CIP code with an enumerated list of programs— thereby excluding master's-level PA degrees from the higher loan cap. Plaintiffs alleged that this revision was unlawful. Plaintiffs further alleged that the Final Rule was internally inconsistent, because several degrees on the DOE's own approved list did not satisfy its newly imposed requirements, and that the DOE improperly relied on PA supervision requirements under state law (a factor appearing nowhere in the statute or the Final Rule's regulatory text) to conclude that PA degrees were not professional degrees. Asserting all three counts under the Administrative Procedure Act (APA), 5 U.S.C. § 706(2)(A) and (C), plaintiffs sought declaratory relief, vacatur of the Final Rule, and a preliminary injunction against its July 1, 2026 effective date.

MINUTE ORDER (paperless), upon consideration of parties' 8 Joint Statement on Consolidation and Proposed Briefing Schedule, in which parties indicated that they "do not object to consolidation" with American Association of Nurse Practitioners (AANP) v. McMahon, No. 26-cv-1780, id. at 2, and report that "plaintiffs in AANP v. McMahon [also]...do not oppose consolidation so long as it does not delay resolution of their preliminary injunction motion already filed in that case," id. at 2, CONSOLIDATING this matter, PA Education Association v. Department of Education, No. 26-cv-1941, with the matter American Association of Nurse Practitioners v. McMahon, No. 26-cv-1780, because both cases involve common questions of law and fact, see Fed. R. Civ. P. 42(a)(2) ("If actions before the court involve a common question of law or fact, the court may...consolidate the actions."). The parties are DIRECTED to file all documents in ONLY the lead case, 26-cv-1780, and are advised NOT to elect the SPREAD TEXT option when filing in ECF, which selection would result in repetitive docketing. This consolidation does not modify any deadlines currently set, by order or by applicable rules, in any of the cases. Further, considering plaintiffs' request in this case "that the Court resolve the motion before the effective date of the challenged rule, July 1, 2026," id., the fact that plaintiffs here are challenging a Final Rule issued over one month ago on May 1, 2026, and the request of plaintiffs in American Association of Nurse Practitioners to not "delay resolution of their preliminary injunction motion already filed," MODIFYING parties' proposed SCHEDULE as follows to ensure sufficient time for consideration of parties' briefs and any hearing that may be held: (1) by 11:59 P.M. on June 9, 2026, defendants shall file any opposition to plaintiffs' 7 Motion and Memorandum in Support of Plaintiffs' Motion for Preliminary Injunction; (2) by 5:00 P.M. on June 12, 2026, plaintiffs shall file any reply in support of their motion; and (3) as necessary, any hearing will be set following completion of briefing on the pending motion for a stay and a preliminary injunction. Signed by Judge Beryl A. Howell on June 5, 2026. (lcbah1)

June 5, 2026

June 5, 2026

Cases Consolidated. This case has been consolidated with case 26cv1780 pursuant to 6/5/2026 MINUTE Order. From this date forward, all pleadings shall be filed ONLY in the lead case, 26cv1780. Parties are advised NOT to elect the SPREAD TEXT option when filing in ECF, as this will result in repetitive docketing. (mg)
