This is a case seeking to prevent U.S. Immigration and Customs Enforcement (ICE) from leasing and operating an apparent holding facility (Holsclaw Property) in unincorporated Santa Clara County, California. On June 10, 2026, Santa Clara County and the State of California filed this lawsuit in the United States District Court for the Northern District of California. They sued the Department of Homeland Security (DHS), ICE, the U.S. General Services Administration (GSA), and ECG-6 (a subsidiary of a real estate company under the National Environmental Policy Act (NEPA), bringing claims for violations of the Immigration and Nationality Act (INA), the Intergovernmental Cooperation Act (ICA), the Administrative Procedure Act (APA), and California law. Represented by the County Counsel, the California Attorney General, and private counsel, the plaintiffs sought a declaratory judgment, a preliminary and permanent injunction preventing implementation of the lease agreement and construction of the facility, and attorneys’ fees.

The plaintiffs alleged that the defendants failed to produce an environmental impact statement (EIS) or assessment (EA) before leasing and constructing the facility. They argued that there were environmental risks to construction, such as disturbance of endangered species and exposure to hazardous materials. NEPA requires agencies to submit an EIS or EA before taking any final action on a proposed development. The INS requires federal agencies to arrange for an appropriate place of detention and to consider using existing facilities prior to developing new ones. The plaintiffs also alleged that the agency defendants failed to provide the County opportunities to consult with them prior to breaking ground, as required by the ICA. Finally, the County alleged that the defendants’ actions breached a contract granted under the Williamson Act, a California law providing tax relief for owners of farmland.

The case was assigned to Judge Eumi K. Lee.

Fourteen days after filing their complaint, the plaintiffs filed a motion for a preliminary injunction. The Court will hear on the motion on September 8, 2026, and the defendants have agreed to pause construction, demolition, and development activities in advance of the hearing.
