This is a case challenging a company’s practices within its credit card program. This is a case challenging a company’s practices within its credit card program. On September 13, 2024, the Consumer Financial Protection Bureau (CFPB) filed this lawsuit in the U.S. District Court for the Western District of Pennsylvania. The CFPB sued Reliant Holdings LLC for violations of the Consumer Financial Protection Act of 2010 (CFPA) and the Truth in Lending Act (TILA). The CFPB alleged that Reliant Holdings targeted financially vulnerable, subprime consumers with advertisements that promised a credit card with a specified credit limit that required no credit check. It further alleged that Reliant Holdings charged consumers fees well in excess of the legally allowed limits and made it unreasonably difficult for consumers to cancel their memberships, among other things. The CFPB sought injunctive and monetary relief, civil money penalties, and attorney’s fees. The case was assigned to District Judge Robert J. Colville.

On December 27, 2024, Reliant Holdings filed a motion to dismiss for failure to state a claim and lack of subject matter jurisdiction. It argued that the CFPB’s funding was unlawful and its interpretations of the CFPA and TILA were incorrect, asserting that its alleged actions did not fall under the prohibited acts outlined in the CFPA and TILA.

On February 27, 2025, the CFPB filed a motion for a temporary stay of sixty days. It argued that with the change in presidential administration, the new Acting Director of the CFPB directed the Bureau’s counsel to not make filings or appearances in any litigation, other than to seek a pause in proceedings. The next day, Reliant Holdings filed a motion to compel the CFPB’s compliance with the court’s September 16, 2024 notice requiring the parties to fully complete the required Rule 26(f) report. It argued that this failure to comply was due to the CFPB’s new Acting Director instructing its remaining counsel to do nothing other than seek a stay of the proceedings. On April 2, 2025, the court granted the CFPB’s motion to stay for sixty days and denied Reliant Holdings’ motion to compel compliance. Judge Colville held that the CFPB could not realistically proceed in the case when its attorneys had been lost, terminated, or placed on leave with the new change in presidential administration. 

On April 23, 2025, the CFPB filed a notice of voluntary dismissal. Later that day, the court dismissed the case. The case is now closed.
