The United States of America filed this lawsuit on May 13, 2026 in the U.S. District Court for the District of Columbia against the District of Columbia's Office of Disciplinary Counsel, the Board on Professional Responsibility, the D.C. Court of Appeals, the District of Columbia, and related officials. The suit arose from disciplinary proceedings against former Assistant Attorney General Jeffrey Bossert Clark. Clark was accused of attempting to pressure Georgia officials to investigate allegations of election fraud and to reconvene the state legislature following the 2020 presidential election. The proceedings centered on a draft letter alleging irregularities in Georgia during the 2020 presidential election—marked pre-decisional, deliberative, and for internal use only—that Clark prepared and advocated internally for sending to Georgia state officials. The draft letter was never sent, and Clark's recommendation was rejected by Acting Attorney General Jeffrey Rosen and Principal Associate Deputy Attorney General Richard Donoghue. The D.C. Office of Disciplinary Counsel filed a specification of charges against Clark on June 29, 2022. Nearly three years later, the Board on Professional Responsibility recommended disbarment on July 31, 2025, though the D.C. Court of Appeals had not yet issued a final decision.

The United States asserted three causes of action: (1) unlawful regulation of the Federal Government in violation of the Supremacy Clause, (2) unlawful discrimination against the Federal Government in violation of the Supremacy Clause, and (3) interference with core Article II executive authority by subjecting internal Executive Branch deliberations to state attorney disciplinary proceedings. The United States sought declaratory and injunctive relief: a declaration that the disciplinary proceedings and findings against Clark were unconstitutional, an injunction prohibiting further proceedings based on his conduct as a federal government attorney, and an award of costs, fees, and other appropriate relief.

This case was assigned to District Judge Richard J. Leon. Judge Leon granted the parties' consent motion for a briefing schedule on June 11, 2026, setting the following deadlines: defendants' motions to dismiss by July 10, 2026; plaintiff’s opposition by August 17, 2026; and defendants' reply by September 10, 2026.

On July 10, 2026, defendants jointly moved to dismiss for lack of jurisdiction.
