On June 4, 2026, represented by the ACLU, two noncitizen plaintiffs filed a putative class action in the U.S. District Court for the Middle District of Tennessee, challenging the constitutionality of Tennessee’s H.B. 1704. The plaintiffs—a 58-year-old Violence Against Women Act (VAWA) applicant and a 35-year-old Deferred Action for Childhood Arrivals (DACA) recipient, both long-term Tennessee residents with final removal orders—alleged that Section 1 of the law, set to take effect July 1, 2026, would criminalize their continued presence in the state. The complaint argued that the law violated the Supremacy Clause by intruding on federal authority over immigration enforcement and conflicting with federal statutes that provide discretionary relief. Plaintiffs sought declaratory and injunctive relief to block enforcement of the law by the state’s Attorney General, Commissioner of Safety and Homeland Security, and 11 District Attorneys General⁴. The suit asserted federal question jurisdiction and proper venue based on events occurring in the district⁵.

ORDER: Pending before the Court are three motions filed by Plaintiff, namely, a Motion for Preliminary Injunction (Doc. No. 6), a Motion for Class Certification (Doc. No. 7), and a Motion for Leave to Proceed Pseudonymously (Doc. No. 8). Via the Moti on for Preliminary Injunction (Doc. No. 6) Plaintiffs ask the Court to issue a preliminary injunction before July 1 to prevent enforcement of Section 1 [of H.B. 1704] against Plaintiffs and the class. (Id. at 2). Due to the time-sensitive nature of t his particular requested relief, Defendants are ORDERED to file a response to the Motion for Preliminary Injunction within ten (10) days of the entry of this Order. Plaintiffs may file a reply to Defendants response to the Motion for Preliminary Inju nction within five (5) days of the filing of Defendants response.
