Notice to Counsel and Litigants Regarding AI-Assisted Research: Attorneys and pro se litigants alike should exercise great caution in submitting any AI-generated language in filings before the Court. Use of AI without verification of the accuracy of the information it generates like any other shoddy research method from other sources or tools implicates Federal Rule of Civil Procedure 11, the central purpose of which is to deter baseless filings in district court and thus to streamline the administration and procedure of the federal courts. Rule 11 applies fully to actions filed by pro se litigants.Therefore, all parties are on notice that the Court has a no-tolerance policy for any briefing (AI-assisted or not) that hallucinates legal propositions or otherwise severely misstates the law. Such filings will often result in sanctions absent reasonable excuse. See generally Willis v. U.S. Bank Nat'l Ass'n et al, No. 3:25-CV-516-BN, 2025 WL 1408897 (N.D. Tex. May 15, 2025). ORDER granting in part, denying in part 32 Motion for Leave to Appear Remotely. Just shy of 3:00 P.M. today, Plaintiffs filed an eleventh-hour request for a witness, Plaintiff Georgia Brown, to appear and testify remotely at the preliminary injunction hearing scheduled for tomorrow at 9:00 A.M. Plaintiffs further requested that counsel for witness Becky Carlson, Attorney Felice Duffy, be permitted to be present through remote video access for Ms. Carlson's testimony.As an initial matter, this hearing has been scheduled since June 15, and Plaintiffs offer no explanation for this eleventh-hour request. Further, it is not the Court's practice to allow remote testimony or participation during civil proceedings. The Court sees no reason to adjust this practice here. That said, the Court grants Plaintiffs' motion in part, with respect to Attorney Duffy's remote appearance. Attorney Duffy will be permitted to observe the hearing remotely through a private video link, which the Court will distribute to Plaintiffs' counsel. She will not, however, be permitted to participate in the proceedings. Plaintiffs' counsel is directed to share the link with Attorney Duffy and must not share the link with anyone other than Attorney Duffy. Plaintiffs' counsel is further directed to remind Attorney Duffy that the proceedings may not be recorded nor the link further shared by her. The Court denies Plaintiffs' motion with respect to the request for Ms. Brown to testify remotely. If testimony from Ms. Brown is necessary, the Court will schedule a second day of testimony, as may be necessary, to accommodate Ms. Brown's travel from the United Kingdom. ORDER on Pretrial Deadlines. The Court has reviewed the parties' 47 Amended Rule 26(f) Report. It is Approved, Adopted, and So Ordered, except as detailed below.As discussed during the telephonic status conference on July 15, 2026, ECF No. 46, the Court hereby bifurcates Count One of the Complaint (the Title IX retaliation claim) from the remaining class claims for purposes of discovery and trial. The Court enters the following Scheduling Order as to Count One. After the retaliation claim is fully adjudicated, the Court, in consultation with the parties, shall set a scheduling order for the remaining claims, recognizing that Defendants intend to seek dismissal of Count Three.Pursuant to Local Rule 16(b), the Court orders as follows: Plaintiffs may move to amend the pleadings or move to join additional parties by September 1, 2026. Defendants shall move to join additional parties and/or respond to any amended complaint by September 30, 2026. All discovery shall be concluded by January 27, 2027. Motions for Summary Judgment, if any, shall be filed by February 28, 2027. The Court will set a date for filing a joint trial memorandum after the close of discovery on Count One. The joint trial memorandum shall comport with this Court's standing order, which will be separately docketed.A post-discovery telephonic status conference is scheduled for February 2, 2027, at 10:00 A.M.
