On May 29, 2026, ten national nursing organizations filed this lawsuit in the U.S. District Court for the District of Massachusetts against the U.S. Department of Education and Secretary Linda McMahon, alleging that the Department's Final Rule unlawfully excludes advanced nursing degrees—including Master of Science in Nursing (MSN), Doctor of Nursing Practice (DNP), and Doctor of Nurse Anesthesia Practice (DNAP) degrees—from the statutory definition of "professional degree." Under the OBBBA, enacted in July 2025, students pursuing professional degrees may borrow up to $50,000 annually and $200,000 in the aggregate in Direct Unsubsidized Loans, while graduate students are limited to $20,500 annually and $100,000 in the aggregate. Plaintiffs alleged that Congress incorporated the Department's preexisting regulatory definition of "professional degree," which uses a three-part test based on preparation for professional practice, advanced skill beyond a bachelor's degree, and professional licensure. Plaintiffs further contend that advanced nursing degrees satisfy all three criteria—a conclusion the Department itself acknowledged in the Final Rule. Nevertheless, the Department promulgated a Final Rule on May 1, 2026, that excluded advanced nursing degrees by imposing additional requirements not found in the statute, including reliance on the illustrative list of professional degrees, doctoral-level expectations, and state supervision requirements for advanced practice registered nurses. Plaintiffs alleged that the rule exceeded the Department's statutory authority and was arbitrary and capricious under the Administrative Procedure Act because it relied on extra-statutory criteria, adopted inconsistent reasoning, and failed to meaningfully respond to thousands of public comments opposing the exclusion. Plaintiffs further alleged that the rule would force many prospective advanced nursing students to delay or abandon graduate education, rely on higher-cost private loans, and worsen existing shortages of advanced practice nurses and nursing faculty. Along with the complaint, plaintiffs moved for a preliminary injunction and a stay of the challenged provisions before the rule's July 1, 2026 effective date. On June 1, 2026, the case was assigned to District Judge Patti B. Saris. 

On June 15, 2026, plaintiffs filed a First Amended Complaint adding the National Rural Health Association as an additional plaintiff while otherwise maintaining the same claims and requested relief. After a hearing on July 1, 2026, Judge Saris took the preliminary injunction motion under advisement and ordered supplemental briefing by July 13, 2026. The case is ongoing.
