On June 9, 2026, three Wisconsin dairy farmers sued U.S. Secretary of Agriculture and the National Dairy Promotion and Research Board in the Eastern District of Wisconsin, alleging mandatory Dairy Checkoff fees were unlawfully used to fund an environmental, social, and governance (ESG) agenda through the Innovation Center for U.S. Dairy, a private entity, thereby violating the Dairy Promotion Stabilization Act of 1983. Plaintiffs sought declaratory and injunctive relief under the First Amendment and APA.
