Filed on June 11, 2026, in the U.S. District Court for the District of Columbia, this complaint was brought by "J6ers Were Destroyed By Weaponization," an unincorporated association representing individuals prosecuted in connection with the January 6, 2021 Capitol events, against the Acting Attorney General of the United States. The complaint alleged that the Department of Justice (DOJ) employed four principal coercive mechanisms that rendered members' guilty pleas constitutionally involuntary: (1) overbroad felony charges; (2) pretrial detention in the DC Jail under alleged inhumane conditions; (3) systematic denial of venue transfer requests; and (4) a "trial penalty" whereby defendants who exercised their right to trial received substantially harsher sentences than co-defendants who pled guilty for identical conduct. The complaint further alleged selective prosecution based on political viewpoint, noting that rioters in Portland, Minneapolis, and elsewhere faced no comparable charges, and cited additional coercive tactics including pre-dawn SWAT-style raids and threats to charge family members. Plaintiff asserted three counts — two writs of mandamus under 28 U.S.C. §§ 1361 and 1651 and a Fifth Amendment due process and equal protection claim — and sought writs directing the Acting Attorney General to review and remedy all affected plea agreements, conduct a formal investigation into DOJ prosecutorial tactics, and obtain declaratory relief that pleas procured through threatened application of § 1512(c)(2) are constitutionally infirm.
