On June 25, 2026, East Bay Sanctuary Covenant and the Immigration Institute of the Bay Area, two nonprofit immigration legal services providers, filed this lawsuit in the U.S. District Court for the Northern District of California against the US Citizenship and Immigration Services (USCIS) and Immigration and Customs Enforcement (ICE) under the Freedom of Information Act (FOIA). On May 7, 2026, the plaintiffs sought policies, communications, and data concerning changes to the processing of DACA renewal requests (Form I-821D) and associated employment authorization renewals (Form I-765), which the plaintiffs alleged had been subject to severe nationwide delays since at least November 2025, causing recipients to lose deferred action and work authorization. USCIS acknowledged the request, granted a fee waiver but denied expedited processing without explanation, and issued no determination by its deadline; ICE never responded at all. Plaintiffs sought declaratory and injunctive relief, expedited processing, a fee waiver, and attorneys' fees.
