Plaintiffs alleged that the designation violated the Administrative Procedure Act (APA), the First Amendment, and the Fifth Amendment because it was unconstitutionally vague and issued without due process. Plaintiffs also challenged the constitutionality of 10 U.S.C. § 4663, which restricts DOD contractors from retaining lobbyists who also represent designated Chinese military companies. The case was assigned to District Judge Eumi K. Lee.

On June 26, 2026, Plaintiffs moved for a temporary restraining order (TRO) and preliminary injunction seeking to block enforcement of the lobbying restrictions in 10 U.S.C. § 4663, arguing that the provision would force DOD contractors to sever relationships with lobbyists who also represented Alibaba, thereby causing irreparable harm. On July 5, 2026, Judge Lee approved the parties' stipulation temporarily prohibiting the DOD from enforcing those lobbying restrictions against Alibaba while the court considers Plaintiffs' motion, preserving the status quo pending a decision on the requested preliminary relief. Plaintiffs' motion for a temporary restraining order and preliminary injunction remains pending.
