This case seeks to uphold a New York law forbidding federal law enforcement officers from wearing masks while interacting with the public in the performance of their duties.

On May 27, 2026, New York passed Senate Bill 9005-C (the “Act”) to "protect the rights of New Yorkers with respect to civil immigration enforcement by the federal government.” The Act prohibited (1) law enforcement officers from wearing masks or other facial coverings, (2) local law enforcement from agreeing to cooperate with federal officers to detain individuals for immigration violations, and (3) localities from subsidizing immigration detention facilities. New York alleged that after passage of the Act, the Department of Homeland Security (DHS) stated that it would not abide by the Act and threatened to send Immigration and Customs Enforcement (ICE) officers to the state. The federal government also filed a lawsuit challenging the Act's legality. New York maintained that the Act did not violate the Supremacy Clause and that it was a lawful exercise of its police power under the Tenth Amendment.

On June 22, 2026, the State of New York filed this lawsuit against the U.S. Department of Justice, DHS, ICE, and the acting heads of those agencies in their official capacities in the U.S. District Court for the Northern District of New York. New York sought a declaration that the Act was a lawful exercise of its sovereign authority along with attorneys’ fees. This case was assigned to District Judge Mae A. D’Agostino and Magistrate Judge Miroslav Lovric.
