On June 26, 2026, the United States filed this lawsuit against the Kentucky Cabinet for Health and Family Services and its Secretary in his official capacity, in the U.S. District Court for the Eastern District of Kentucky. The federal government sought to compel production of five years of SNAP eligibility, allotment, and EBT transaction records that USDA requested under 7 U.S.C. § 2020(a)(3) for a centralized SNAP Information Database created pursuant to Executive Order 14243. Kentucky was among twenty-two non-compliant state agencies whose states had challenged USDA's requests in California v. USDA, No. 3:25-cv-06310-MMC (N.D. Cal.). The complaint alleged that USDA's Third Records Request of May 15, 2026 cured defects that the court had identified in Califorina v. USDA, and that defendants unreasonable refused to produce records. The United States sought a declaratory judgment of noncompliance and an injunction requiring production of records. The case is ongoing.
