TEXT ORDER regarding 4 Motion for Preliminary Injunction by United States of America: Plaintiff the United States of America initiated this action in the Western District of New York on June 22, 2026, and, on June 23, 2026, filed a motion for preliminary injunction. Briefing and a hearing related to Defendants' subsequent motion to transfer venue and to dismiss Defendant Russo were conducted. On July 13, 2026, this matter was transferred from the Western District of New York to the Northern District of New York and has been assigned to the undersigned. Plaintiff's motion for preliminary injunction remains pending and no answer or reply deadlines were previously set. Upon review of Plaintiff's complaint and the pending motion, the Court hereby ORDERS Defendants to show cause before this Court, United States District Court for the Northern District of New York, at the James T. Foley U.S. Courthouse, 445 Broadway, Albany, New York 12207, Tuesday, July 21, 2026, at 2:00 p.m., or such other date as may be fixed by the Court, why a preliminary injunction, pursuant to Rule 65 of the Federal Rules of Civil Procedure, should not be issued enjoining Defendants, their officers, agents, servants, employees, attorneys, and all other persons who are in active concert or participation with any of the Defendants, from enforcing N.Y. Civil Rights Law §§ 10002 and N.Y. Exec. Law § 170-k against the Federal Government.
