On July 10, 2026, fifteen states filed this lawsuit in the U.S. District Court for the Western District of Washington at Seattle. The states sued the U.S. Department of Education (DOE) and its Secretary in her official capacity, asserting violations of the Administrative Procedure Act (APA) and Spending Clause. The states alleged that the DOE unlawfully terminated mental health grants under the Mental Health Service Professional Demonstration Grant Program (MHSP) and the School-Based Mental Health Services Grant Program (SBMH). They claimed the DOE abruptly discontinued funding by imposing new, unpublished DEI priorities through internal directives in February and June 2026, despite a prior permanent injunction in Washington v. U.S. Department of Education prohibiting such actions. They further alleged that the DOE planned to terminate "Protected Grants" by July 31, 2026, under a "Washington Plan" that circumvented the injunction and violated procedural requirements under the General Education Provisions Act (GEPA), along with Title VI and Title IX of the Civil Rights Act. The states sought declaratory and injunctive relief barring the defendants from enforcing the directives and the Washington Plan. The case was assigned to District Judge Kymberly K. Evanson.

That same day, the states moved for a preliminary injunction, or in the alternative, a temporary restraining order (TRO) barring the defendants from enforcing the directives and the Washington Plan. They argued that they were likely to show that the Plan and directives were contrary to law and that injunctive relief was necessary to avoid irreparable harm while being in the public interest.

On July 27, 2026, the court granted the states’ motion for a TRO. The court found the states likely to succeed on their APA claims, holding that the DOE’s plan to terminate school mental health grants—based on unpublished priorities, including a prohibition on DEI initiatives—was arbitrary, capricious, and contrary to law. It further concluded that the termination plan constituted a "final agency action" subject to judicial review and that the states had sufficiently demonstrated irreparable harm to grantees and the public interest. 2026 WL 2150222.

This case is ongoing.
