On July 9, 2026, the United States filed this lawsuit in the U.S. District Court for the District of Maryland against the State of Maryland, challenging the State's Community Trust Act S.B. 791, which barred local correctional facilities from asking about a person's immigration status, from holding or transferring a person at the request of federal immigration authorities absent a judicial warrant, and from notifying authorities that a person was in custody; it also barred state law enforcement from sharing information absent a court order.
The complaint alleged that the Act was expressly preempted and conflict preempted. The federal government further alleged that by requiring judicial warrants where federal law authorizes civil administrative warrants, and by singling out federal immigration authorities by name, the Act unlawfully regulated and discriminated against the federal government in violation of intergovernmental immunity.
