On July 22, 2026, two legal services nonprofits filed this lawsuit in the U.S. District Court for the Northern District of California against U.S. Citizenship and Immigration Services, the Department of Homeland Security, and their heads. The plaintiffs challenged USCIS's position that the $250 application fee for Special Immigrant Juvenile Status (a protection for children who have been abused, neglected, or abandoned by a parent), who had never been charged a filing fee before, could not be waived for indigent children. They alleged that USCIS violated the APA because it gave no reasoned explanation, it adopted the policy through a fee notice rather than notice-and-comment rulemaking, and that because applicants lose eligibility permanently at twenty-one, children who cannot raise the $250 fee in time lose the protection.
