On August 3, 2026, twenty-three states and the District of Columbia filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiffs sued the Administration for Children and Families (ACF) along with several other federal agencies and officials, each named in their official capacities, asserting violations of the Administrative Procedure Act (APA) and Spending Clause. The plaintiffs alleged that the ACF’s June 23, 2026 System of Records Notice (SORN) unlawfully authorized the disclosure of sensitive Temporary Assistance for Needy Families (TANF) recipient data to third parties, exceeding the agency’s statutory authority and violating federal privacy laws. They further claimed that the SORN was issued without proper notice-and-comment procedures under the APA and imposed undue burdens on states, including compliance costs and potential erosion of recipient trust. The plaintiffs sought declaratory and injunctive relief barring the defendants from implementing the TANF SORN, and attorney’s fees. The case was assigned to District Judge James E. Boasberg.

On August 5, 2026, the plaintiffs filed a motion for a preliminary injunction and a stay under 5 U.S.C. § 705. They argued that they were likely to succeed on the merits, that they would suffer irreparable harm absent relief, and that the balance of equities and public interest favored relief. 

On August 17, 2026, the plaintiffs filed an amended complaint, adding the U.S. Department of Homeland Security (DHS) and its Secretary in his official capacity as defendants and expanding the scope of their legal challenges to include a September 2025 data transfer and data disclosure policy. 

That same day, the court ordered the plaintiffs to file a new motion for a preliminary injunction and § 705 stay by August 25. 

This case is ongoing.
