This case challenges the expansion of a federal Temporary Assistance to Needy Families (TANF) records system and adoption of “Routine Use 10” by the Department of Health and Human Services (HHS), the Administration for Children and Families (ACF), and the Office of Family Assistance. The policy would allow sensitive information about current and former TANF recipients and their household members to be collected from additional sources and shared with other entities for broadly defined “program integrity” purposes. The plaintiffs allege that the policy exceeds the agencies’ authority, violates federal privacy and confidentiality laws, and is procedurally defective and arbitrary and capricious under the Administrative Procedure Act.
