This case challenges a DHS ruling limiting the duration of permitted stays for nonimmigrant students and foreign-media representatives. On August 17, 2026, plaintiffs composed of higher-education organizations, faculty/labor unions, and journalists’ unions filed this suit against the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), and the respective heads of those two agencies.


For the past forty years, international students, exchange visitors, and representatives of foreign media have all been admitted to the United States under the "duration of status" framework, permitting flexibility to accommodate the unique educational or employment circumstances inherent in the education and journalism spaces. However, on August 28, 2025, DHS and ICE published a proposed rule that would replace this framework with a fixed-period system, with no individual's period exceeding 4 years plus 30 days for student visitors and 240 days for foreign-media visitors. The rule also restricts program changes, transfers, and degree enrollment and reduces the F-1 grace period from 60 to 30 days. Despite substantial public comment opposing the proposed rule, Defendants published the Final Rule on July 17, 2026, with no meaningful changes to the proposed rule.


Plaintiffs argue that the Final Rule itself, as well as the insufficient opportunity for public participation in the rule-making process, is arbitrary and capricious, and that the Final Rule exceeds Defendants' statutory authority, all in violation of the Administrative Procedure Act (APA). They assert that the rule will harm students, universities, research, journalism, and the U.S. economy while also overwhelming immigration agencies.


The case was assigned to Judge F. Dennis Saylor, IV. On the same day the complaint was filed, Plaintiffs filed a motion for a preliminary injunction to stay or postpone the September 15, 2026 effective date of the Final Rule. In the alternative, Plaintiffs sought summary judgment in their favor.


This case is ongoing.
