This action challenges Section 301 tariffs on imports from 60 economies, alleging that USTR exceeded its authority by imposing near-uniform duties on substantially all covered imports without tying them to specific foreign practices involving forced labor. Plaintiffs also allege that the tariffs are arbitrary and capricious and, if authorized by Section 301, would constitute an unconstitutional delegation of Congress’s tariff power.
