This case challenges the Services’ rescission of longstanding Endangered Species Act protections for imperiled species’ habitat by eliminating the regulatory definition of “harm.” Plaintiffs allege that the rule violates the ESA, APA, and NEPA and unlawfully removes protections against habitat modification or degradation that can harm endangered and threatened species.
