This case challenged the Department of Homeland Security's "Unlawful Voter Initiative," which allegedly used flawed data to generate noncitizen voter target lists and deployed armed agents to conduct intimidating home visits during early voting in nine states.

On September 18, 2026, the California Nurses Association, National Nurses United, City and County of San Francisco, City and County of Santa Clara, and Voto Latino Foundation finland a complaint in the United States District Court for the Northern District of California against the Department of Homeland Security (DHS), its officials, and several other related government agencies and officials. The case was assigned to District Judge Araceli Martínez-Olguín.

Per the complaint, DHS, under its Unlawful Voter Initiative Policy, deployed armed DHS agents to engage in “face-to-face voter eligibility interrogations during the height of electoral activity.” In the name of election integrity, Homeland Security Investigations (HSI) Unit agents knocked on doors, questioned those they believed were noncitizens, and investigated them for allegedly attempting to vote. A DHS spokesperson stated, “HSI is actively rooting out and investigating election fraud wherever it can be found” and “Our message to aliens who vote in American elections is clear: we will find you, arrest you, and you will face the consequences–including criminal charges and deportation.”

The agents' conduct, tactical gear, and distribution of images and videos on social media suggest that the purpose of the DHS investigations was intimidation. The Trump administration declined to abide by prior internal regulations that limited federal law enforcement agencies’ ability to operate in an intimidating manner around the time of an election.

DHS also targeted voter assistance and mobilization organizations. For example, the New York Times detailed in a June 2026 article that HSI agents worked with the FBI to raid the offices and homes of numerous individuals associated with the Ohio Organizing Collaborative, a non-partisan group that conducts voter registration drives.

To facilitate the investigations, the DHS generated allegedly faulty lists of people who it suspects have registered or voted as a non-citizen, “using an algorithmic analysis of unreliable government information systems or from White House-provided lists.”

Plaintiffs raised several claims. First, they alleged that Defendants violated Section 11(b) of the Voting Rights Act of 1965 which prohibits voter intimidation by conducting door-to-door investigations and targeting voter mobilization services. Second, Plaintiffs alleged that Defendants violated the U.S. Constitutional right to vote found in interpretations of the First and Fifth Amendments. Third, Plaintiffs alleged that Defendants violated Separation of Powers and Federalism principles under the Elections Clause, Voter Qualification Clause, and the Seventeenth Amendment, each of which assumes that the states have the “primary responsibility and duty to decide who is eligible to vote both in state and federal elections and how to administer the election.” Fourth, Plaintiffs alleged that Defendants violated the Administrative Procedure Act by taking unlawful or excessive agency action and because the final agency action was arbitrary and capricious, given its reliance on a target list based on defective source data.

On September 21, 2026, Plaintiffs filed a motion for preliminary injunction to compel Defendants to cease allegedly intimidating conduct while the case remains pending. The motion hearing on the preliminary injunction is scheduled for October 19, 2026.

As of October 12, 2026, this case is ongoing.
