For the foregoing reasons, Plaintiffs’ motion for summary judgment, [ECF No. 46 ], is GRANTED with respect to Counts 3 and 4, and the C ourt vacates and sets aside the Executive Order Footnotes as contrary to law and arbitrary and capricious in violation of 5 U.S.C. § 706(2).
