[This summary is temporary while we research this case.]

On October 5, 2026, the American Association of University Professors (AAUP), its Harvard and Boston University chapters, the Service Employees International Union (SEIU) and its affiliates, Americans for Immigrant Justice, and six individual plaintiffs filed suit in the United States District Court for the District of Massachusetts against the U.S. Department of Homeland Security (DHS), U.S. Citizenship and Immigration Services (USCIS), and their respective leaders. The plaintiffs challenged two policies issued by the Trump-Vance administration in 2026—the Adjustment of Status (AOS) Policy and the Denial Policy—alleging they unlawfully restricted immigrants’ ability to apply for lawful permanent resident (LPR) status without leaving the country. The complaint asserted that the policies violated the Immigration and Nationality Act (INA), the Administrative Procedure Act (APA), and the Due Process Clause by imposing arbitrary denials, bypassing notice-and-comment requirements, and forcing separations from families and communities. Plaintiffs sought declaratory and injunctive relief, including vacatur of the policies and an order requiring adjudication consistent with existing precedent. Jurisdiction was premised on federal question authority and venue in Massachusetts due to the presence of certain plaintiffs.

This case is ongoing.
