Case Summary

(This summary is temporary as we research the case.) On September 2, 2026, plaintiffs sued the Department of Homeland Security, the DHS Secretary, and the Attorney General in their official capacities in the U.S. District Court for the District of Columbia. The plaintiffs challenged DHS’s July 2026 claims, sent in letters to four states’ election officials, that more than 250,000 noncitizens were registered to vote, including about 190,000 in California, along with its demands that states run their voter rolls through federal databases or lose federal grants. The plaintiffs alleged that this undisclosed database matching violated the Privacy Act, the Administrative Procedure Act, and the Elections Clause of the Constitution, due process under the Fifth Amendment, and separation of powers under the Constiutution.

Order on Motion to Reassign Case

Oct. 19, 2026

MINUTE ORDER granting the 24 Motion to Reassign. "The general rule is that all new cases filed in this courthouse are randomly assigned in order to ensure greater public confidence in the integrity of the judicial process, guarantee fair and equal distribution of cases to all judges, avoid public perception or appearance of favoritism in assignments, and reduce opportunities for judge-shopping." Dakota Rural Action v. U.S. Dep't of Agric., No. 18-cv-2852, 2019 WL 1440134, at *1 (D.D.C. Apr. 1, 2019) (cleaned up). "The burden on the party claiming relation is heavy as random assignment of cases is essential to the public's confidence in an impartial judiciary." Id. Here, the Plaintiffs have not met their burden. The Plaintiffs marked this as a related case under Local Civil Rule 40.5, which provides that "related cases" shall be assigned to the judge with the oldest case and civil "cases are deemed related when the earliest is still pending on the merits in the District Court and they (i) relate to common property, or (ii) involve common issues of fact, or (iii) grow out of the same event or transaction or (iv) involve the validity or infringement of the same patent." LCvR 40.5(a)(3), (c)(1). The Plaintiffs claim that this case is related to League of Women Voters v. DHS, No. 25-cv-3501. But the Defendants are correct that when this case was filed on September 2, 2026, League of Women Voters was no longer "pending on the merits," LCvR 40.5(a)(3), having been terminated on June 22, 2026, after the Court resolved the Parties' summary judgment motions. Indeed, when the Plaintiffs initiated this case, the Government had already filed its notice of appeal in League of Women Voters, and the D.C. Circuit was considering the Government's stay application. The Court disagrees that the post-judgment activity by the League of Women Voters plaintiffs regarding enforcement of the Court's judgment meant that League of Women Voters was still "pending on the merits" when this case was filed. LCvR 40.5(a)(3). Moreover, although the Court need not reach the Defendants' remaining arguments to resolve the 24 Motion to Reassign, it doubts that this case "involve[s] common issues of fact" or "grow[s] out of the same event or transaction" as League of Women Voters. LCvR 40.5(a)(3). League of Women Voters involved a challenge to the overhaul of the Systematic Alien Verification for Entitlements (SAVE) database by the Department of Homeland Security (DHS) and the Social Security Administration, whereas this case challenges certain actions by DHS and the Department of Justice directed at California. The sole similarity is that this case involves use of the SAVE database. But not every case that implicates the use of SAVE is related to League of Women Voters. "Scrupulous adherence to Local Rule 40.5 is important to avoid any appearance of judge-shopping or favoritism in assignments and to assure the public that cases were assigned on an impartial and neutral basis." Trump v. Comm. on Ways & Means, U.S. House of Representatives, 391 F. Supp. 3d 93, 97 (D.D.C. 2019) (cleaned up). Accordingly, the Clerk of the Court is directed to reassign this case randomly, pursuant to LCvR 40.3, as the exception provided for "related case" assignment in LCvR 40.5 does not apply. Signed by Judge Sparkle L. Sooknanan on 10/19/2026. (lcsls3)

Order on Motion to Show Cause AND Order on Motion to Strike

Nov. 3, 2026

MINUTE ORDER: The Court ORDERS that the Government's 45 Motion to Strike and Show Cause is DENIED. The Court's Order contemplated public filings with personally identifying information redacted. In addition, Plaintiffs permissibly used the data from the lists to successfully make their standing arguments. To the extent that the declaration from Plaintiffs' experts drew general conclusions about the list's reliability, the Court finds that such analysis was reasonably related to establishing the risks facing CHIRLA's members and thus to its standing. No violation of the Court's Order occurred here. So ORDERED by Chief Judge James E. Bosberg on November 3, 2026. (lcjeb3)
