Case Summary

On May 5, 2006, Plaintiffs, represented by several private law firms, filed a 42 U.S.C. 1983 class action lawsuit in the U.S. District Court for the Western District of New York, challenging the constitutionality of the Niagara County Sheriff's blanket strip search policy. Specifically, Plaintiffs alleged that, following their arrests for petty crimes, they were subjected to the Sheriff's blanket policy of strip-searching all individuals who entered the Niagara County Jail, regardless of the c…

On May 5, 2006, Plaintiffs, represented by several private law firms, filed a 42 U.S.C. 1983 class action lawsuit in the U.S. District Court for the Western District of New York, challenging the constitutionality of the Niagara County Sheriff's blanket strip search policy. Specifically, Plaintiffs alleged that, following their arrests for petty crimes, they were subjected to the Sheriff's blanket policy of strip-searching all individuals who entered the Niagara County Jail, regardless of the crime for which they were charged and despite the absence of reasonable suspicion to believe that they were concealing weapons or contraband. Plaintiffs claimed that such a policy violated the Fourth and Fourteenth Amendments to the United States Constitution. To remedy the alleged violation, they requested that the court issue declaratory and injunctive relief, monetary and punitive damages, and class certification. Defendants answered by generally denying all allegations.

The case was assigned to District Judge William M. Skretny, who subsequently assigned it to Magistrate Judge Hugh B. Scott for handling of pre-trial proceedings. Magistrate Judge Scott entered a scheduling order on August 2, 2006, and discovery ensued.

On July 6, 2007, Plaintiffs moved for class certification and Defendants opposed the motion. At the time of this summary, the certification issue was still pending before the Court.

ORDER OF MAGISTRATE JUDGE HUGH B. SCOTT TEXT OF THE ORDERThis case has been referred to the undersigned for pretrial proceedings. A scheduling conference will be held on August 28, 2006 at 2:00 pm, in the chambers of the undersigned. PRIOR TO THE SCHEDULING CONFERENCE, THE PARTIES ARE DIRECTED TO COMPLY WITH THE REQUIREMENTS OF RULE 26 OF THE FEDERAL RULES OF CIVIL PROCEDURE. This means that, at a minimum, (1) the parties are to have exchanged initial disclosures as required by Rule 26(a)(1); (2) the parties are to have met or conferred as required under Rule 26(f); and (3) the parties are to have submitted a proposed discovery plan to the Court at least 7 days prior to the scheduling conference as also required by Rule 26(f). Also, the Magistrate Judge is available to conduct any or all proceedings in a jury or non-jury civil matter and to order the entry of judgment in the case pursuant to 28 U.S.C. 636(c). Attached hereto is a Notice of Right to Consent to Disposition of a Civil Case by a United States Magistrate Judge, together with a consent form, for consideration by the parties. The parties are encouraged to consider and act favorably on such consents; however, it is emphasized that there will be no substantive adverse consequences should the parties elect not to do so.
