The State of Florida imposed numerous restrictions in response to the virus. Universities sent home students, Supervisors of Elections closed or moved numerous polling stations, and numerous individuals quarantined. Despite these circumstances, state officials still planned to hold the Florida presidential primary as scheduled on March 17, 2020.

One March 16, 2020, one day before the Florida presidential primary, Dream Defenders, the New Florida Majority Education Fund, Organize Florida Education Fund, and several individuals who would have been prevented from voting due to COVID-19 restrictions, filed a lawsuit in the U.S. District Court for the Northern District of Florida. The lawsuit, Williams v. DeSantis, was assigned to Judge Robert L. Hinkle under docket number 1:20-cv-00067.  The initial complaint named Florida Governor Ron DeSantis, Secretary of State Laurel Lee, and the Florida Elections Canvassing Commission as defendants. The plaintiffs sought emergency declaratory and injunctive relief that would order the state to implement additional voting measures and enjoin it from enforcing the existing voting deadlines. They alleged that the state “failed to take reasonable emergency measures” for voter participation in light of the pandemic, such as extending deadlines for absentee ballots and expanding vote-by-mail options. Represented by the National Center for Law and Economic Justice, DEMOS, and LatinoJustice PRLDEF (Puerto Rican Legal Defense and Education Fund), the plaintiffs brought this lawsuit under 42 U.S.C. § 1983, the Americans with Disabilities Act and Section 504 of the Rehabilitation Act. Specifically, the complaint alleged that forcing the plaintiffs to appear at the polls in person in order to vote violated their First Amendment rights and their Fourteenth Amendment rights under the Equal Protection Clause. Further, the plaintiffs suffering from medical vulnerabilities contended that the Americans with Disabilities Act and the Rehabilitation Act required the defendants to provide reasonable accommodations for voting. 

On the same day, the plaintiffs also filed an emergency motion for a temporary restraining order and preliminary injunction. They asked the court to order the state to expand access to vote-by-mail options, extend deadlines, permit curbside voting, and communicate all such changes to Floridians.

On March 17, 2020, the court denied immediate relief to the plaintiffs, stating that granting the order would be “adverse to the public interest.” Nevertheless, the court noted that the lawsuit could address and seek to remedy future elections.

The plaintiffs renewed their request for emergency relief later that day, discarding the request for curbside voting, but continuing to request extended access to vote-by-mail and absentee options. On March 18, 2020 the court again denied the motion with respect to the March 17 primary. He noted it “would be adverse to the public interest to enter a temporary restraining order or preliminary injunction blocking the Secretary of State and Supervisors of Elections from processing the results of the March 17 presidential primary in accordance with the governing Florida statutes.” The motion for a preliminary injunction remained pending insofar as it addressed future elections. 

The plaintiffs then filed a series of amended complaints. On April 20, 2020, the first amended complaint addressed the likely harm Florida voters would face in federal elections because of COVID-19. The plaintiffs argued that in the absence of changes, Florida’s existing vote-by-mail and third-party voter registration laws, in addition to the state’s online voter registration system, would interact in a way that would deny and abridge the plaintiffs’ votes on account of race in violation of Section 2 of the Voting Rights Act. The Zebra Coalition, which provides services to LBGTQ+ youth, also joined the complaint as a plaintiff.

On May 4, 2020, Alianza for Progress, Florida Alliance for Retired Americans, Priorities USA, and several individual voters sued Florida Attorney General Ashley Moody and Commissioner of the Florida Elections Canvassing commission Jimmy Patronis in the U.S. District Court for the Northern District of Florida, filing in conjunction with their complaint a notice of similar case. On May 5, 2020, the case, Nielsen v. DeSantis, No. 4:20-cv-00236, was also assigned to Judge Hinkle as a related case.  

In their complaint, the Nielsen plaintiffs alleged that Florida’s laws and practices governing mail voting burdened and disenfranchised thousands of people during the COVID-19 crisis.  The Nielsen plaintiffs filed an amended complaint on May 20, 2020.   

Meanwhile, on May 19, 2020, the state defendants in both cases filed a motion to consolidate. On May 22, 2020, the District Court granted the motion and consolidated Williams and Nielson, with Nielson as the lead case.   

On May 27, 2020, the plaintiffs in the consolidated action renewed their motion in support of a preliminary injunction for necessary relief for Florida voters affected by COVID-19 in future elections. 

Over the course of litigation, several parties intervened on both sides. The District Court granted various Republican organizations the right to intervene in the case on May 28, 2020, over opposition from the plaintiffs. 

Then, on June 10, 2020, the court allowed five blind individuals and the Florida Council of the Blind to intervene on issues related to voting. That same day, the court dismissed the claims against Governor DeSantis without prejudice, pursuant to stipulation by the parties.

Plaintiffs in the consolidated action filed a second amended complaint on June 21, 2020, adding 134 county Supervisors of Elections and County Canvassing Boards as defendants. This complaint also addressed how the defendants’ signature match and “cure” procedures for vote-by-mail ballots denied eligible voters the chance to cast a ballot without giving them the chance to fix any alleged errors. The plaintiffs alleged that the same signature and “cure” procedures disproportionately impacted Black and Brown voters.

On June 24, 2020, the court denied plaintiffs’ motion for a preliminary injunction on all issues but one. 2020 WL 5552872. The order noted that the plaintiffs largely failed to show they would suffer irreparable harm because no elections were scheduled between the time of the court’s order and the impending trial. However, the court declined to issue a ruling on a claim that blind individuals have a right to cast a remote secret ballot. The plaintiffs had argued in the motion for the preliminary injunction that the state needed at least 45 days to order and create a system to redress the denial of the right. Yet at that point, the defendants had not responded to the plaintiffs’ motion. Therefore, the court declined to decide the issue until defendants had issued a response to the plaintiffs’ motion. 

In a third amended complaint filed on June 25, 2020, the plaintiffs added claims against DeSantis in his official capacity as a commissioner of the Florida Elections Canvassing Commission, instead of in his official capacity as governor. 

On May 27, the defendants filed several motions to dismiss, arguing that the plaintiffs lacked standing. The defendants also filed a motion to dismiss for lack of subject matter jurisdiction, claiming that voting procedures involved in the case present political questions outside the jurisdiction of federal courts. On June 30, 2020, the court granted in part and denied in part the defendants’ motion to dismiss. 469 F. Supp. 3d 1261. Regarding standing, the court recognized that mostly all the individual and organizational plaintiffs had standing to challenge the voting provisions to minimize their health risks posed by COVID-19 or based on alleged diversion of resources. The individuals and the members of the organizations who wished to have their ballots delivered by others, but were prohibited from doing so by the ballot-delivery restriction, had standing to challenge the restriction. The one exception was the Zebra Coalition, which had not sufficiently alleged a connection between its mission and the challenged voting procedures. The court dismissed the claims against the Florida Elections Canvassing Commission for lack of redressability, then narrowed the claim against Florida’s Attorney General to only deal with the challenged ballot-delivery provision. Finally, the court rejected the Secretary of State’s claim that voting procedures presented political questions outside the jurisdiction of the federal courts. On the merits, the court dismissed several of the plaintiffs’ claims regarding postage. The court reasoned that requiring a voter to pay for postage to mail a registration form or ballot to a Supervisor of Elections was not unconstitutional or unlawful. Additionally, the court found no issue with different counties adhering to different practices on prepaid postage or the location of ballot drop boxes. 

 Finally, the court addressed the remaining claim from the plaintiffs’ previous motion for preliminary injunction on July 2, 2020. The court denied the claim that the failure to provide a method for blind individuals to prepare a remote secret ballot violated the Americans with Disabilities Act and the Rehabilitation Act of 1973. 2020 WL 5552871. The court reasoned that the plaintiffs could only prevail if there was a feasible, reliable, secure method by which blind individuals could cast a remote secret ballot. The court acknowledged that the plaintiffs could prevail at trial, but they would not suffer irreparable harm in the meantime. The court explained that ordering the defendants to act more quickly, with the attendant risk that any action would turn out to be unnecessary or even ill-advised, would be adverse to the public interest: “On all voting issues, but especially on this one, the carpenter's dictum rings true: measure twice, cut once.” 


One of the claims the plaintiffs had raised in the first amended complaint, filed on April 20, 2020, involved a violation of the Voting Rights Act. Under Section 203, election officials in certain counties must provide materials in appropriate languages other than English. The plaintiffs alleged this had not been done in various counties. The defendants filed a motion for summary judgment on this claim on May 27, 2020. On July 6, 2020, the court granted the defendants’ motion for summary judgment as to the Section 203 claim against the Supervisors of Elections of Broward, Hardee, Hendre, Lee, Osceola, and Polk Counties. The order noted that the Supervisors in the relevant counties had established that they provided certain materials to voters in both Spanish and English. 2020 WL 5552870. However, the Voting Rights Act claim remained pending against the Secretary of State and the Supervisors of Elections of DeSoto, Miami-Dade, Orange, Palm Beach, Pinellas and Seminole Counties.


On July 19, 2020, shortly before the trial was slated to begin, the parties reached a final settlement. Under the agreement, the Secretary of State promised to host at least one workshop for the Supervisors of Elections before the general election. The parties intended that the workshop would both educate and encourage the Supervisors on a number of voting-related initiatives.In particular, the workshop was intended to educate the Supervisors a number of initiatives, including the use of prepaid postage for vote-by-mail ballots; the use of Coronavirus Aid, Relief, and Economic Security (“CARES”) Act funds for pre-paid postage and voter accessibility issues; the use of CARES Act funds and other available resources to better comply with the CDC’s recommendations for election polling locations; the acquisition and use of any new voter accessibility technologies approved or conditionally approved by the Secretary, organizing with the Supervisors and funding strategic tests of available accessibility technology for the August 18, 2020 primary.

 

The parties also intended that the workshop would encourage the Supervisors to undertake other matters, such as working with the U.S. Postal Service on the use of first-class mail for the delivery and return of vote-by-mail ballots; using intelligent mail barcodes to track their vote-by-mail ballots; maximizing the use of drop boxes for vote-by-mail ballots consistent with Florida law; informing voters about the availability of drop boxes for vote-by-mail ballots; using their websites and other platforms to make vote by-mail ballots request forms and ballots themselves available in Spanish; and using the maximum number of early voting days available to them so, under Executive Order 20-149, they could utilize the additional canvassing days and maximize the availability of mandatory drop boxes for vote-by-mail ballots.


Additionally, the agreement stipulated that the Secretary develop a one-page document specifically for Supervisors in counties without pre-paid postage. With the help of CARES Act funding, the one-page document would allow the affected Supervisors to inform voters that if the voters could not afford return postage for their ballots, then they could return the vote-by-mail ballot at drop boxes the Supervisor maintained or at the Supervisor’s Office. The document would also direct voters to contact their Supervisor to learn about additional return options and delivery options.


Consistent with the State’s obligations under Section 203 of the Voting Rights Act, the settlement agreement also instructed the Secretary to undertake a social media or other public relation campaign to inform voters of the three available voting options in Florida ahead of the November 2020 General Election: (1) vote-by-mail, (2) early in-person voting, and (3) in-person Election Day voting. The campaign needed to highlight the safeguards designed to protect the integrity of Florida elections. The agreement placed emphasis on the Secretary promoting voting options to college-age voters, communities of color, and seniors. The settlement agreement also committed the Secretary to contact eligible, but unregistered Floridans through the multi-state partnership known as the Electronic Registration Information Center (“ERIC”).  


Next, the agreement mandated that the Secretary consider good faith improvements to Florida’s online voter registration system before the November 2020 general election. Furthermore, the agreement required the Secretary to hold a workshop to solicit more feedback about the system after the general election, but before December 31, 2021. Finally, the Secretary also agreed to organize a tabletop exercise with state and local election officials, representatives of both political parties, law enforcement partners, and other stakeholders to identify best management practices for election officials leading up to the 2020 general election.The settlement agreement noted that the parties were responsible for their own attorney’s fees and costs. 


The next day, July 20, 2020, the court entered an order granting a motion for voluntary dismissal of the consolidated actions pursuant to the settlement agreement. The court  dismissed with prejudice all claims raised by two individual plaintiffs in the original Williams complaint, as well as all claims as to the state-level defendants. The court dismissed without prejudice the claims raised against the county-level defendants, as well as the Williams’ plaintiffs’ claim challenging the failure to provide an accessible method for virtually or manually impaired voters to cast a private and independent mail ballot. The court then dismissed all other claims of the Nielsen and Williams plaintiffs with prejudice. However, the court referred the claims of the intervening plaintiffs, which involved voting accommodations for blind individuals, to Magistrate Judge Martin A. Fitzpatrick for a settlement conference. On August 5, 2020, the court granted the intervening plaintiffs’ motion for voluntary dismissal with prejudice, after reported settlement of their claims, and closed the consolidated cases. (Although the Clearinghouse has not been able to locate a copy of this settlement agreement, contemporaneous news articles suggest that the agreement would implement a program allowing blind and print-impaired voters to fill out ballots online.)   This case is now closed.
