On November 6, 1995, African American employees filed a lawsuit under 42 U.S.C. § 2000e against Griffin Wheel Company in the United States District Court for the Northern District of Alabama. The Plaintiffs, represented by private counsel, claimed that Defendant discriminated against them by denying them promotion out of bargaining unit positions into non-bargaining unit positions.

On August 30, 1996, the Court (Judge William M. Ackers, Jr.) consolidated four other ongoing cases against Griffin Wheel Company into this litigation - docket numbers 96-3299, 96-798, 96-830, and 96-112. Although some of the added plaintiffs were also alleging discrimination in employment on the basis of race, some plaintiffs in the consolidated cases claimed that Griffin Wheel Company discriminated against them on the basis of their sex.

The Court denied Plaintiffs' motion to amend their complaint to invoke Rule 23 for the purpose of seeking class certification. Murry v. Griffin Wheel Company, 182 F.R.D. 459 (N.D. Ala. 1997). Instead, the Court ordered that the case would proceed as a case of consolidated individual cases.

On August 21, 1998, the Court denied Defendant's multiple motions for summary judgment.

On October 28, 1998, the Court granted the parties' stipulation to dismiss the case with prejudice. The parties were to bear their own costs. No details of any settlement terms are available.
