ORDER granting 20 MOTION to File Amicus Brief In Opposition to Plaintiffs' Motion For Preliminary Injunction. The federal decisions cited by the parties are divided as to whether ACLU amicus briefs have been accepted in similar cases. The response indicates that the amicus brief advocates the same position as the government and is essentially duplicative. To avoid having to read the amicus brief to resolve that issue, thereby defeating the purpose of the response, the Court asked a law clerk to do so and to advise whether the brief is duplicative. Based upon that source, the Court is satisfied that while the issues are similar, the analysis is somewhat different. The Court therefore is willing to consider the brief, just as it would be willing to consider an amicus brief from an organization opposed to the government's position. By Judge R.
