Case Summary

This case concerns alleged wealth-based discrimination in a deferred prosecution program for marijuana possession. On August 23, 2018, three Maricopa County, Arizona residents who were referred to Maricopa County's marijuana diversion program filed this class action lawsuit in the U.S. District Court for the District of Arizona. The plaintiffs sued Maricopa County and Treatment Assessment Screening Center, Incorporated (“TASC”), a private company, under 42 U.S.C. § 1983. The plaintiffs, represented by the Civil Rights Corps and private counsel, sought injunctive and monetary relief, claiming violations of the Fourth and Fourteenth Amendments. They alleged that the Maricopa County Attorney's Office and TASC jointly operated a marijuana possession diversion program that discriminated against the poor in violation of the Fourteenth Amendment, and led to unreasonable searches and seizures in violation of the Fourth and Fourteenth Amendments. The diversion program allowed criminal defendants charged with marijuana possession to complete treatment and program requirements for 90 days, in exchange for suspending prosecution.

Specifically, the plaintiffs claimed that they faced longer terms of imprisonment, repeated drug tests, and increased fee payments because they could not pay fees associated with the program. One class member individually sought injunctive relief to prevent Maricopa County from keeping her in the diversion program if she could not pay the fees associated with completing the program. The case was assigned to District Judge James A. Teilborg but immediately reassigned to District Judge Steven P. Logan.

On October 12, 2018, the case was reassigned to Judge James A. Soto. That same day, the plaintiffs filed an amended complaint that added a third class representative.

In January 2019, the parties agreed to magistrate judge jurisdiction and the case was assigned to Magistrate Judge Eric J. Markovich.

After the submission of the amended complaint, several defendants moved to dismiss the claims against them. Magistrate Judge Eric J. Markovich denied those motions on June 18, 2019. The court held that the plaintiffs sufficiently pleaded the elements of a 42 U.S.C. § 1983 claim and that no statute of limitations concerns existed because the violations were ongoing. Because the plaintiffs sued TASC as an organization, and not in an individual capacity, Judge Markovich ruled that TASC was not entitled to qualified immunity. Additionally, the court held that the County Attorney (1) was not subject to sovereign immunity because he was part of a municipality, and (2) could be sued because he oversaw the alleged discriminatory practice. 2019 WL 2515950.

The plaintiffs filed a second amended complaint on September 23, 2019, adding another class representative. The court adjudicated discovery disputes throughout 2020 and 2021.

On January 28, 2020, the plaintiffs notified the court that a class representative had died of unrelated causes. The court substituted the son of the deceased plaintiff as a named plaintiff on June 23, 2020. 2020 WL 3440288. Two other plaintiffs were voluntarily dismissed on February 10, 2020.

On July 30, 2020, the plaintiffs and the county defendants notified the court that they had reached a settlement on all claims except for those regarding attorneys’ fees. They jointly moved for dismissal with prejudice of all the relevant claims on October 27, 2020. The court granted this motion and dismissed the claims on November 3, 2020. The parties engaged in settlement talks regarding attorneys’ fees throughout 2020 and 2021.

On January 27, 2021, the plaintiffs and the county defendants announced that they had reached an agreement on the attorneys’ fees issue. Upon the parties’ stipulation, the court dismissed the attorneys’ fees claims and the case against the county defendants with prejudice on May 5, 2021.

Unable to reach a settlement with the plaintiffs, TASC moved for summary judgment on March 10, 2021 and to stay discovery on March 23, 2021. The court declined to stay discovery on April 27, 2021. 2021 WL 1627233.

The plaintiffs moved for class certification regarding the claims against TASC on October 15, 2021. Magistrate Judge Markovich heard oral argument on TASC’s summary judgment claim on December 2, 2021.

The court denied TASC’s motion for summary judgment on December 30, 2021. Magistrate Judge Markovich held that a genuine issue of material fact existed as to whether the plaintiffs could pay the diversion program’s fees. Thus, the issue should be decided by a jury. The court also clarified that the plaintiffs only had viable Fourth Amendment claims for individuals who were extended on the diversion program solely because of their inability to pay the fees within 90 days. 562 F. Supp. 3d 168.

During the first few months of 2022, the parties litigated evidentiary issues before trial and unsuccessfully attempted to reach a settlement agreement. The parties entered mediation in April 2022, and the court suspended the active motions pending the results of mediation. In June 2022, the parties reached an agreement in principle. They worked to iron out the agreement’s specific terms over the next year.

On April 6, 2023, the plaintiffs submitted an unopposed motion for preliminary approval of a settlement agreement and certification of the proposed settlement class. The agreement included the following terms:

The plaintiffs would receive a total of $2,600,000 ($1,600,000 paid directly from TASC; $1,000,000 paid from TASC’s insurer)
Each settlement class member would receive $1,000, plus an additional $15 for each day the member remained on pay-only extension
The named plaintiffs would each receive $40,000
The plaintiffs would initially request $250,000 in attorneys’ fees. If additional funds remained in the settlement fund after the full administration of the claims process, the plaintiffs’ attorneys could petition for additional attorneys’ fees

The court preliminarily approved the class action settlement on July 28, 2023. After the plaintiffs requested a deadline extension, they moved for final approval of the class action settlement on March 25, 2024.

The case is ongoing as of April 11, 2024.
