MINUTE ORDER: Local Rule 40.5(a)(3) provides that "[c]ivil, including miscellaneous, cases are deemed related when the earliest is still pending on the merits in the District Court and they (i) relate to common property, or (ii) involve common issues of fact, or (iii) grow out of the same event or transaction or (iv) involve the validity or infringement of the same patent." This rule "guarantees fair and equal in assignments, and reduces opportunities for judge−shopping." Tripp v. Executive Office of the President , 196 F.R.D. 201, 202 (D.D.C. 2000) (Calendar Committee three−judge panel). A plaintiff that seeks to depart from that general rule "bears the burden of demonstrating that the case is a related case under an applicable subsection of Rule 40.5." Tripp v. Executive Office of the President , 194 F.R.D. 340, 342 (D.D.C. 2000). The two cases at issue here, Las Americas Immigrant Advocacy Center V. Wolf et al. , 19−cv−3640, and L.M.−M. et al. v. Cuccinelli et al. , 19−cv−2676, challenge different policies, implemented by different component−agencies, and turn on different legal theories. Moreover, it is not sufficient that the two cases touch on the same general subject matter; that is, that the two cases challenge policies that allegedly restrict asylum seekers' access to counsel during the credible fear process. The Court, accordingly, concludes that Plaintiffs have not satisfied their burden of showing that the cases are related for the purposes of Local Rule 40.5(a)(3). MINUTE ORDER. In L.M.-M. v. Cuccinelli, No. CV 19-2676 (RDM), 2020 WL 985376 (D.D.C. Mar. 1, 2020), Judge Randolph Moss set aside the USCIS directive that instituted a 24-hour consultation window prior to an asylum applicant's credible-fear interview. Given that the complaint in the instant case implicates, among other things, the 24-hour consultation period that has allegedly been implemented by USCIS in the context of the Prompt Asylum Claim Review and Humanitarian Asylum Review Process programs, this Court requires supplemental briefing regarding the relationship between the policy that was vacated in the L.M.-M. case and the one that is at issue here. Therefore, it is hereby ORDERED that, on or before May 4, 2020, Defendants shall file a brief of no more than 10 pages that addresses whether and to what extent the policies that Plaintiffs challenge in the instant case and those addressed in L.M.-M overlap.
