Case Summary

This class action challenged aspects of Hamblen County, Tennessee’s practice of setting money bail in criminal proceedings. On February 16, 2020, the named plaintiffs filed this lawsuit in the United States District Court for the Eastern District of Tennessee. They sued the Hamblen County General Sessions Judge, the Hamblen County General Sessions Circuit Court Clerk, the Judicial Commissioners of the Hamblen County General Sessions Court, and the Hamblen County Sheriff under 42 U.S.C. § 1983 and 28 U.S.C. § 2201. The plaintiffs sought to certify as a class all individuals who (1) were, or would be, in the custody of the Hamblen County Sheriff, (2) whose bail amount was set in an ex-parte fashion, (3) who have not waived and have not received an individualized bail hearing within a reasonable period of time, and (4) who remain in custody for any amount of time

As a result of their inability to post bail, the named plaintiffs were detained in the Hamblen County Jail, which, at the time of filing, operated at around 150% capacity and was described by the Sheriff as a “cesspool of a dungeon” in this New York Times article. Represented by the Civil Rights Corps, the Institute for Constitutional Advocacy and Protection at the Georgetown University Law Center, and private counsel, the plaintiffs argued that the ex-parte (without presence of the other party or their counsel) imposition of a money bail violated the Fourteenth Amendment. Specifically, they argued it constituted wealth-based detention in violation of the Due Process and Equal Protection clauses because it detained individuals solely for indigence. Moreover, they argued that detention for failure to post bail without an individualized hearing violated the plaintiffs’ substantive due process right to pretrial liberty without detention being a narrowly-tailored remedy to serve a compelling government interest. Finally, the plaintiffs argued that the county’s bail practices violated their rights to procedural due process by denying them notice, the opportunity for a hearing, the opportunity to present evidence and make arguments, findings explaining the basis for bail, and a finding by clear and convincing evidence that pretrial detention was necessary due to the person’s inability to post bail. The plaintiffs also argued that the imposition of money bail without providing them with counsel violated their Sixth Amendment right to counsel at a critical stage of criminal proceedings that led to pretrial detention.

The plaintiffs sought a declaratory judgment, a temporary restraining order (TRO) releasing the named plaintiffs unless they were provided the procedural safeguards which the complaint argued were required, a permanent injunction requiring Hamblen County to adopt the procedural safeguards in future proceedings and avoid pretrial detentions solely for indigency or without confidence that the detention was narrowly tailored to serve a compelling government interest, and attorneys’ fees and costs.

The case was assigned to District Judge Clifton L. Corker and Magistrate Judge Cynthia R. Wyrick.

On the same day as they filed their complaint, the plaintiffs moved for a TRO for the named plaintiffs, a preliminary injunction seeking to enjoin Hamblen County from detaining individuals for failure to post bail without an individualized hearing, and class certification. On March 2, 2020, the Court denied the motion for a TRO as moot. On August 28, 2020, the Court directed the plaintiffs to revise and refile their motion for class certification. On November 30, 2020, the Court granted the motion for a preliminary injunction. The Court granted the revised motion for class certification on May 5, 2021.

On October 8, 2021, the plaintiffs moved for summary judgment on all claims. On March 16, 2022, the Court denied the motion for summary judgment without prejudice because discovery disputes had delayed resolution on the merits. On April 29, 2022, the parties cross-moved for summary judgment. The plaintiffs sought summary judgment on all claims while the defendants moved for summary judgment only on the claim that the challenged practices constituted unlawful wealth-based detention.

On September 21, 2023, the Court granted the defendants’ motion for partial summary judgment, holding that detention for failure to post bail was not detention solely for indigence; therefore, the state only had to pass a rational-basis test under the Due Process and Equal Protection clauses, which the state did. Accordingly, the Court denied the plaintiffs’ motion for summary judgment on that claim. The Court also denied the plaintiffs’ motion for summary judgment on the substantive due process claim, holding that the Eighth Amendment’s protection against excessive bail already serves to protect criminal defendants against undue pretrial detention. The Court granted the plaintiffs’ motion for summary judgment on the procedural due process claim, holding that the challenged practices denied the plaintiffs an opportunity to be heard in a meaningful manner at a critical stage in their criminal proceedings. However, the Court did not hold that the plaintiffs were entitled to a “clear and convincing” evidentiary standard for determining if bail was necessary to assure their appearance at trial. The Court granted the plaintiffs’ motion for summary judgment on the Sixth Amendment claim, holding that the plaintiffs were entitled to counsel at their bail hearings. Finally, the Court denied the motion for a permanent injunction without prejudice, finding it premature to rule conclusively at that time. 2023 WL 6166523.

On November 20, 2023, the defendants moved again for summary judgment, this time on the substantive due process claim and also claimed that the Sixth Amendment right to counsel did not apply at bail hearings separate from initial appearances. On September 30, 2024, the Court granted the defendants’ motion for summary judgment on the substantive due process claim, restating their holding from the 2023 opinion. The Court denied the defendants’ motion for summary judgment on their Sixth Amendment argument as moot because the plaintiffs did not argue that they were entitled to counsel at pretrial proceedings that did not affect pretrial detention or release. Lastly, the Court granted the plaintiffs’ motion for a permanent injunction, ordering the defendants to conduct their bail hearings in a manner consistent with the September 21 order that held the challenged practices violated the Sixth Amendment and substantive due process.

As of July 28, 2026, the Court is hearing disputes over calculation of attorneys’ fees. The defendants did not appeal either of the Court’s rulings on the merits.
