This case is about the legality and constitutionality of voting procedures in Arizona. The plaintiffs, which included several individual voters, Kirkpatrick for U.S. Senate, the national and senatorial Democratic Party committees, and the former chairman of the Navajo Nation filed this action in the U.S. District Court for the District of Arizona on April 15, 2016, against the Arizona Secretary of State, elections officials in Maricopa County, and the Arizona Attorney General. Represented by private counsel, the plaintiffs challenged several aspects of the voting laws and procedures in Arizona. The plaintiffs alleged violations Section 2 of the Voting Rights Act, the Equal Protection Clause of the Fourteenth Amendment, and the First Amendment.

In their complaint, the plaintiffs alleged constitutional violations stemming from several aspects of Arizona's voting laws and procedures. First, the plaintiffs cited Maricopa County's voting procedures surrounding the 2016 primary elections. The plaintiffs alleged intolerably long lines in the 2016 primary election in Maricopa County, in which the number of polling stations in the county was drastically cut from the previous elections. The plaintiffs further alleged that these voting conditions had adverse and disparate impacts on the Hispanic, African-American, and Native American citizens of Arizona, causing extra burden to these citizens due to the allocation of polling locations throughout the county and making it more likely that their votes would be rejected based on voting in an improper precinct. Second, the plaintiffs took issue with Arizona's prohibition on out-of-precinct provisional ballots, which prevented those voting in the wrong precinct to have their votes counted. Third, the plaintiffs alleged violations stemming from a state law, H.B. 2023, which prohibited the collection of early vote ballots, with certain exceptions.

The plaintiffs contended that the interaction of Arizona's prohibition on out-of-precinct provisional ballots and the effects of discrimination against Hispanics, African-Americans, and Native Americans caused members of these minority communities to have their right to vote abridged or denied. The plaintiffs stated that H.B. 2023 would also disparately and adversely impact Arizona's minority populations and their right to vote if not enjoined. The plaintiffs alleged that under the totality of the circumstances, these voting practices violated Section 2 of the Voting Rights Act by restricting the opportunity of Hispanic, African-American, and Native American citizens of Arizona to exercise their right to vote.

The plaintiffs also argued that Arizona's voting procedures violated the Equal Protection Clause of the Fourteenth Amendment by creating a strong likelihood that the individual plaintiffs' right to vote, their constituencies' and members' right to vote, and the right to vote of other Maricopa County residents would be severely burdened in the 2016 election. The plaintiffs argued that the alleged misallocation of polling stations, the refusal to accept out-of-precinct provisional ballots, and the ban on the collection of absentee ballots would each weigh disproportionately on minority voters and that no state interest outweighed these burdens.

The plaintiffs also alleged that Arizona's voting policies violated the Equal Protection Clause by treating two groups differently: fully eligible Arizona voters who can't have their vote counted outside their precinct in a precinct-system county and fully eligible voters who can have their vote counted outside their precinct in a vote-center county. The plaintiffs argued that this system treated Arizona citizens in a disparate way based purely on the county in which the live, without any rational justification, thereby depriving them of equal protection under the law.

The plaintiffs also argued that H.B. 2023, by banning the collection of absentee ballots, violated the First and Fourteenth Amendments by infringing on the right of political parties and their members to engage in election-related political activity. They also contended that H.B. 2023 violated the First and Fourteenth Amendments by intending to suppress the vote of Democrats because of the way the vote.

The plaintiffs requested declaratory relief as well as a preliminary and permanent order enjoining the defendants and other officials of the State of Arizona from allocating polling locations for the 2016 general election without first submitting the plan to the court for review under the Constitution, Section 2 of the VRA, and other federal and state laws. The plaintiffs also requested that the injunction prevent state officials from rejecting provisional ballots solely because they were cast in the wrong precinct or polling location and prohibit the enforcement of H.B. 2023's ban on collecting absentee votes.

The case was assigned to Judge Douglas L. Rayes. On April 19, the plaintiffs filed an amended complaint. The complaint added Hillary for America ("Clinton Campaign") as a plaintiff. On April 29, Bernie 2016, Inc. ("Sanders Campaign") moved to intervene in the case. The Arizona Republican Party also moved to intervene in the case on May 9. The court granted both motions to intervene on May 10. The same day as Judge Rayes granted the two motions, the Sanders Campaign filed a complaint-in-intervention. The complaint incorporated and re-alleged all of the allegations and causes of action of the amended complaint, while also requesting the same relief.

On June 10, 2016, the plaintiffs moved for a preliminary injunction on the polling place allocation and provisional ballot claims. They followed this motion with another preliminary injunction motion on the H.B. 2023 claims on the same day. On June 17, the Arizona Republican Party filed a motion to dismiss for failure to state a claim and a motion to dismiss for lack of jurisdiction. Over the summer of 2016, the parties continued briefing for the preliminary injunction motion and the motions to dismiss. On September 9, 2016, the parties filed a joint notice of settlement regarding the allocation of polling locations in Maricopa County. This settlement dismissed the Maricopa County election officials from the litigation.

On September 23, 2016, the court denied the plaintiffs' motion for a preliminary injunction of H.B. 2023. The court stated that the plaintiffs were not likely to succeed on their claims regarding H.B. 2023. The court said that the plaintiffs had not shown sufficient evidence of a statistically relevant disparity between minority and white voters, which is necessary to succeed on a VRA Section 2 claim. The court also did not find that the plaintiffs were likely to succeed on their First and Fourteenth Amendment claims regarding H.B. 2023. On the same day, the plaintiffs appealed the denial of the motion for a preliminary injunction to the Ninth Circuit Court of Appeals (USCA Case Number 16-16698).

On October 28, 2016, the Ninth Circuit affirmed the district court's denial of a preliminary injunction against the enforcement of H.B. 2023. The court held, in an opinion by Judge Sandra S. Ikuta, that the voters failed to show that the law imposed a discriminatory burden on minority voters; that the law only imposed minimal burdens on the First and Fourteenth Amendments; that the law served the interests of fraud prevention and preserving election integrity; and that the law did not implicate protection associational rights under the First Amendment.

The Ninth Circuit panel used a two-part framework to analyze the Voting Rights Act challenge. First, the challenged law must impose a discriminatory burden on members of a protected class. Second, the burden must in part be caused by or linked to social and historical conditions that have or currently produce discrimination against members of the protected class. The court found no error in the district court's finding that the plaintiffs had not shown that the burden of H.B. 2023 impacted minorities over non-minorities and therefore affirmed the district court's conclusion that the plaintiffs were not likely to succeed on the merits of the VRA claim.

Next, the Ninth Circuit panel analyzed the constitutional claims and used a multi-factor balancing test. The court weighed the character and magnitude of the asserted injury to the rights protected by the First and Fourteenth Amendments against the precise interests put forward by the state, while also considering the extent to which the state's interests make it necessary to burden the plaintiffs' rights.
